Your response is also very similar to responses I have seen from your firm to other clients who have described concerns with the level of service, communication, and support they received. Rather than addressing the underlying feedback, the response appears focused on defending the firm's position. Regarding the notice itself, I think it is important not to minimize what occurred based solely on the title of the document. Whether your firm characterizes it as a New York State Request for Information rather than an "audit," it was a tax-authority inquiry concerning my tax filing that required documentation and a response. The distinction in terminology does not change the fact that I contacted the tax professional who prepared my return because I needed guidance and assistance responding to that inquiry. As for my records, they were ultimately provided, but only after multiple calls to your office followed by an email advising that the documents needed to be released by a specific date and time. So while you can accurately state that the records were eventually delivered, that does not address the communication and service issues that led to the escalation in the first place. More importantly, the issue regarding depreciation was not simply that I later became interested in obtaining a depreciation schedule. During the engagement, I was not clearly advised that this documentation was necessary to properly establish the depreciable basis or appropriately allocate the property between land and building. As the tax professional engaged to prepare my return, I expected your firm to request the information necessary to properly prepare the return and to guide me through those requirements. That did not occur. That is the feedback I believe your firm should take from this experience. Rather than focusing on defending the wording of a review or distinguishing between an audit and a request for information, I would encourage the firm to use this feedback to improve clarity, communication, documentation requests, and client education during the engagement. Those are the issues that ultimately matter to the client.
