No one helped the person up. The manager-on-duty never came to see the victim or take a report. The victim called the store from home to report the incident and was hung up on. They called bacl to again attempt to make a report, but a customer service rep refused to take a report or even make a note to save the relevant store surveillance tape. The victim took pics of the obstrucion and pics of the resulting injuries and legally recorded the hang-up and rude phone conversations. They aslo well as noted witness names. The actual store manager eventually confirmed they could find and preserve the survillance recordings of the fall and its aftermath. Elderly abuse. Disability abuse. Failure to attend to a fall victim on the floor. Failure to take a report X3. Overt discrimination. Pics of the obstruction violation. Pics of injuries. Recordings of phone calls of obvious disrespect and failure to comply with minimum standards of duty of care ... And what does the "intake specialist" at Merrigan say to the viictim: "No ambulance transport or doctor's report? It's all heresay. We won't be able to take this case." HEARSAY? Merrigan lawyers who care nothing about blatant discrimination, at-fault premises liability, victim abuse, well-documented post-incident pics and recorded phone conversations, failures to meet minimum standards of decency and accountability, witnesses, emotional stress liability and damages, and more should be called out for their ignorance, greed, parasitic conduct, and unethical behavior. Twice I spoke with a client rep to complain. Nothing changed. I felt very little sense of concern for my case and a $400K starting point for damages resulted in less than $50K. Most upsetting was the fact they told me in January of 2025 that the insurer we were going after was not the right insurer but they were willing to throw us a bone to go away. Then I was told the real insurer was who we would go after but after they threatened Kelly Lawyers with a frivolous lawsuit Kelly backed down. So the original insurer lied and Kelly bought it. The second insurer was not liable. I regret the decision to hire this firm. The money will not cover the damages I suffered with three of my teeth dying from a fractured eye socket. I am sure they'll dispute this review. But I spent three months crafting it and soul searching about what I needed to say. This is what happened. The insurance company lied. Kelly did not thoroughly investigate.
