Dan Heon, the broker advised me to do a 'rent-to-buy' with the then tenants of the Chestermere property. Dan ill advised me put $15,000 of my mom's money into a joint account with the tenant that was to be a credit towards a down payment for them to purchase the home. The tenant had been living in the home for nearly 12 years. The credit was to help them towards purchasing the home and with upgrades that were necessary (new appliances, etc.). I hired Bill to close the purchase of the home. A couple of months into the process of the sale and a couple of days from closing Bill recuses himself from the closing. He said that what Dan had instructed us to do was mortgage fraud. He contacted the tenants lawyer and they too recused themselves. Bill had me sign all the necessary paperwork (title transfer etc.) prior to my leaving the country. I believed this was a done deal. In addition to being out of the country, I had gone ahead and approved landscaping on another property and other necessary improvements based on the monies I thought were coming from the sale of the home. I had my work base transferred to Toronto (effective 1st September) again based on the sale of the property. I was stressed and sick- it led to a miscarriage and I was taken off work for a month. I returned to work and commuted to Toronto for 4 months before having to be taken off work again due to stress and anxiety. The home has been on the market nearly 9 months with no offers. On top of everything I put the house I had landscaped (which I live in) also on the market as a reaction to the deal falling through on the Chestermere property in hopes I could quickly access the cash I needed. The tenants downstairs moved out because I put the house on the market. That house has also been on the market for the same amount of time and with no offers. Two mortgages, two property taxes, two utilities, two insurance policies with no respite and no rental income. It doesn't end here though- the tenant decided to steal the $15,000 that had been placed in the joint account on the advice of Dan Heon. And even though TD Bank assured me repeatedly that monies could not be withdrawn without all signatories, this was in fact not the case. The bank made a coding error (conveniently) and my tenant was able to withdraw the monies whilst I was out-of-the country and the deal was falling through. I called Bill and asked him to call the tenant as she was not picking-up my calls. Bill did so, and failed to advise me that he was charging me $600/hour. By the time it was all said and done the tenant extracted a rent-free month in the property and Bill invoiced me for over $2000 for the emails/phone calls he made to the tenant. I was charged an additional $1000 for sale of the property (when I had been quoted a flat rate of $750). In the invoice itself he itemized charges for recusing himself on the 18th August and he charged me for the 21st & 22nd August even though I had not contacted him. I contacted him on the 23rd in desperation upon learning the tenant had been able to withdraw the $15,000. So $3000 and some change later and two properties, a ton of debt, no cash and complete chaos and I call scammers. Bill, Dan (who was never to be heard from again) and TD Bank (who has apologized for the error but refuse to compensate me for the losses incurred) are all meant to be licensed and reputable professionals. But all three have caused irreparable damage and loss to my life, my health and my family's.
