    Five Stars Without Hesitation…read more I cannot speak highly enough about Attorney Michael Thaler and the incredible work he has done for me.     My wife and I are going through a divorce and my income dramatically decreased recently because I…read morelost my job. I tried to lower my child support obligation and my wife and I agreed to use Ms. Choteau Levine to mediate our dispute to see if we could resolve it without having to go to court. Ms. Levine is a former family law judge so we thought she would be a good choice. After over 3 hours of back and forth, we were unable to reach any agreement at all. This is of course not Ms. Levine's sole responsibility, as my wife and I were just unable to come to terms. However, when you are paying $450 an hour, you expect the person to bring a certain expertise to the table. I did not find that she really added anything to the process. Yes, she warned us of the perils of going to trial and the benefits of controlling the process ourselves by reaching an agreement, but that was about it. She also had us separate into different rooms after her initial questions. Although this is fairly common among mediators these days, I am not a fan of it. To me, it undercuts the primary benefit of mediation, which is to get the parties talking and listening to each other. While separating us might make it easier on the mediator b/c it reduces the contentiousness, I don't think it serves the parties b/c it just reinforces an already overly adversarial process. When I did meet w/ Ms. Levine alone, my confidence was soon shaken when she admittedly miscalculated the proposed child support amounts, not once but twice. She also failed to take into account a provision of the law that allows the payor to reduce his obligation if the parties have a wide disparity in incomes. Her attitude appeared to be that that was a technicality and not worth discussing. However, because it significantly raised the amount of support that I was proposing, it undermined my negotiating position. When my wife proposed a complete settlement proposal to end the entire case, I declined because it involved some retirement assets. Ms. Levine appeared mildly disappointed, and opined that she did not think I would be entitled to any of my wife's retirement money because it was merely transferred from other accounts and not made as part of her employment. She made this recommendation despite not even asking to see the post-nuptial agreement which clearly stated that I was entitled to any contributions to her retirement funds. This reinforced my feeling that she was more interested in settling the case than listening to my opinions or allowing me to make wise decisions. This was particularly concerning because my wife had an attorney and I did not. Finally, Ms. Levine lost me for good when she refused to take my last counter-offer to my wife and her attorney. She said "They're done. I'm done. Its yes or no." So, I said no. Apparently, after 3 hours, she felt that she personally had had enough. Because she didn't specifically state that my wife had told her that their latest offer was a "take it or leave it" proposition, I don't know if her ultimatum was coming from my wife or Ms. Levine. Unfortunately, I didn't ask her. Regardless, she refused to take my final offer to my wife. I was stunned. Here I was, unemployed and paying this woman $225 /hr for a final total of $750 (my share) and she refused to spend another five minutes to convey my final offer to my wife and her attorney. I will probably never know if she would have accepted it, and we had to go to court the next day. Apparently, $1,500 does not go as far as it used to.
