This individual engaged in unacceptable "games," manipulating good people's emotions & wasting precious time. While not an attorney & unable to definitively comment on the legality (in NJ) of what occurred, I feel compelled to share my experience to help others avoid the anguish my family endured. I was asked to assist my Sr. parents in selling their long-term home. This associate, acting as both buyer/acting agent, should be held to a higher standard of professionalism/ethics. INSTEAD, she engaged in behavior that's utterly appalling! Not an attorney, but I suspect her actions might even warrant a license revocation, though it may first require going through legal disclosure to obtain essential docs enabling inquiries/depositions to uncover exact timelines. Even if what she did was technically legal, it was completely uncalled for!! Here's what transpired: On a Tues eve, my agent submitted an offer from a Pausch associate that was about $20,000 below asking price. Out of an abundance of (totally undeserved) respect, I'm omitting the realtor's name, but my parents promptly decided to counter the offer the next day. Note the timeline: Wednesday evening, this agent/potential buyer was still negotiating, acting as if she genuinely wanted to buy the home. Within 15 minutes of receiving our counter, they asked if we could split the difference. (IE: ACTIVELY engaging with a counter offer of her own). I don't know what her potential motive/mindset was as here's what occurred: After the agent countered, I quickly communicated our acceptance to our agent. I even agreed in a respectful, friendly,& professional note to work with her for the quick close she desired, despite the logistical difficulties it created. We were willing to do anything necessary to facilitate an easy close. Little did we know, this woman was just toying with us!! To our dismay & my parents' distress, our agent later informed us that the seller encountered "difficulty" sending the written contracts Wed evening, promising they'd arrive by the following morning. That should have been our 1st red flag. Imagine our shock when we learned the next day that she wouldn't fulfill her promise BECAUSE she had ALSO put in an offer on a SECOND property that, according to my agent, had UNFATHOMABLY COMPLETED ATTORNEY REVIEW!! (uncertain if completed Wed night or Thurs morning, but pretty irrelevant) As this behavior was ethically questionable & timeline highly suspicious as to motive/logic. If you were in my position, would you want the stress of navigating this while helping your elderly parents sell their home? Why would you put in a counteroffer that was immediately accepted in under 15 mins, when you were literally hours away from completing attorney review? WHO DOES THAT?!? Given how quickly we responded, if the buyer had genuine interest in our home, & even if mere hours away from the other home's review, she still had time to complete the written contract. The fact that she didn't, tells me she had no genuine interest & was just acting irresponsibly & cruelly! - Legal doesn't always mean right, particularly for licensed professionals. - Submitting an offer just hours (well under 24!) prior to completing attorney review Ozn ANOTHER home is reckless. ⁃ WHAT TYPE OF AGENT/BUYER DOES THIS? And how does the owner of this firm condone such behavior? This demonstrates a complete lack of respect for my parents' (the sellers) emotions/well-being. My family believed they had successfully entered into a sale, only to have their hopes cruelly shattered! This was completely unnecessary!! It's clear the buyer/agent had no genuine intent to complete the transaction, so why entertain the offer/counter offer?! Conversations with friends, including attorneys/realtors, have confirmed my belief that this conduct is an egregious breach of ethical standards and unacceptable in business. Even if NJ law allows simultaneous offers, why choose to do so at the last possible moment? It raises serious concerns about their judgment & practices! I would not want to engage with this firm as a seller or buyer; their ethics appear suspect. With countless reputable & skilled realtors in NJ, no justification for working with this firm. Their behavior raises questions: Why the delay in sending contracts? Why the lack of communication? I attempted to reach the owner multiple times (via urgent emaill/calls) respectfully, only to be met with silence. Is it so difficult to address unethical practices?
