Has anyone ever heard of a real estate company suing an individual for not using their services? After being shown homes by an agent at Century 21 Davis, here in Grass Valley I found a home, on my own. The house was not on the market. I entered into an agreement directly with an owner. There were no real estate agents involved. We simply went down to a title company who guided us through the process (so easy!) and we signed papers. After an escrow period was over and I was satisfied with the inspections the home became mine. When I informed my agent she "reminded me" that I signed an agreement. I asked that she send a copy because I did not remember signing any agreement other than two different offers on two places. She surprised me by sending the copy which had my signature. I looked through the papers I had. I did have the original copy. It was attached to one of the offers I made. That's when it came back to me. She went over the offer document very carefully. There was a lot going on in the office. She introduced me to other members of the staff and conversations were flying about. We were in a hurry; I saw no reason to doubt what I was signing when she presented the other form. She said it was a necessary form to sign because the home was located in Placer County where she was not licensed. She most certainly introduced it as something other than what it was and did not go over a single point on that form. She stapled the form under the offer documents and off we went to look at the property again and meet with the owner's agent. That deal fell apart and not too long after I entered into an agreement with the neighbor of a good friend to purchase his place. I paid top dollar for a place with no garage and no landscaping but it was close to my friend and a lake...two important factors. Little did I know at that time that Century 21 expected me to pay $7,500 in sales commission. They have since sent many demands in various ways for payment including sending an email to a commercial address where I use to work and many people ended up reading it. They sent a person to my home who announced they were a process server and who dropped off yet another demand for payment. The process server didn't "serve" anything. Someone drove onto my property yesterday, through my private gate, onto my driveway and announced they were there to take photos because they were a real estate appraiser. What was THAT about? Is Century21 Davis positioning to sue me? They have been demanding mediation, saying I agreed to it but, to my mind, I did not agree to it. They may have my signature but they obtained it in a deceptive way. Now they are engaged in, at the very least, an intimidation process which is very disturbing to me. What kind of an outfit works like this? Up until this time I had a positive experience and would have recommended them to my friends. Now, never! read more
