I didn't second guess it at the time, but upon using it for the first time, I found that it was not new. The vape was Smok brand and supposed to be a premium model. It also comes with 2 refillable pods. The pods that were included were 2 different kinds, and one of them had been used already. The other pod doesn't work in the device at all.
