I was driving southbound on 75 last Saturday when I found myself about 200-300 feet back of a Big D cement truck. My windshield was getting pummeled by small debris coming from the back of this truck. As I was attempting to maneuver out of the barrage of projectiles slamming into my windshield, there was a thunderous boom. I initially thought that a massive piece of concrete had hit the underside of my Suburban as both my and my 13 year old daughter let out a simultaneous, "What was that?" However, my daughter looked towards the back seat and notice that the driver side quarter panel glass had been completely shattered and glass was all over the third row seat. I quickly changed lanes and sped up so my daughter could get pictures of the license plate and company name. The name on the truck in big blue and black letter was Big D Ready Mix Concrete. I immediately looked the company up on my phone and called the main number in dispatch. I spoke with a dispatcher and explained what had happened and that this truck needed to get off the road immediately. She asked my for a 3 digit truck ID number, but I as unable to provide it as it was not in the picture of the driver side door that my daughter had taken. She then asked for my location and that she could figure out which truck it was using their GPS tracking system. Next, she asked for my phone number and said she would text me so I could send pictures of the damage and the cement truck. An hour past with no text message so I called her back and she said she had texted me and would text me again. On the second try, I received her text and sent her the pictures. Two hours past with no response and no phone call so I texted her back and she said she had sent the pictures and my number to their safety guy (Justin) and that he would be calling me. I gave them until about noon on Monday (over 48 hours and my car undrivable) and called back. They actually had an option on their automated system to report unsafe driving. It fell under the HR menu so I thought I might actually get to speak to someone who could rectify the situation. A guy name Jacob answered the phone. I explained what had happened and that I was supposed to get a call from Justin, but had not heard back. He said he would contact Justin and have him call me. To my surprise, Justin called me back just a few minutes later and asked for the details on what happened. After explaining what happened, he said he would talk with his boss and get back to me. With no communication after four hours, I texted Justin for a status update and his exact response was "I spoke to Jacob and he stated that they would not be liable for this. He said you could claim this on your insurance and if they want they can subrogate against our insurance." Just to clarify, Jacob is the same person I spoke with when I hit he "unsafe driver option" and is clearly the decision maker in these situations. So why wouldn't he talk to me directly instead of having me speak with his subordinate and then not tell me why he feels they are in no way liable? Pretty simple, this is an incredibly unethically run business and based on other reviews posted about them, I can't imagine why anyone would risk doing business with this company as they clearly take no responsibility for their actions. I am thankful that I didn't have a car full of kids in the car (which is often the case) who would have been covered in glass and potentially seriously injured or that the concrete didn't go through the windshield, injuring my daughter or me, or causing me to veer out of control and potentially killing someone (I wonder if Jacob would still feel Big D has no culpability). But you be the judge if you think this company has no liability for their actions and is worth doing business with. read more
