Our Renault car was bought three years ago. We booked at Arnold Clark for its first MOT at the end of the three year warranty.The gears had always been stiff and we were told that we should have reported it when we first noticed it three years ago. With this in mind, why did the Arnold Clark mechanics not notice it or report it. The Gear box packed in a month later, but even though the law says that a purchase should be fit for purpose up to 6 years in England, where we bought the car originally, the Renault dealers would not give way and give us the full refund on the cost of the gear box. Instead they charged us £585 saying that the gear box had worn out. This is ridiculous for a three year old car regardless of the fact we did 60,000 miles. That is not a high enough to make a gear box pack in. Trading standards say that by two acts 1979 and 1980, we should have had the gear box replaced free of charge as this is not a wear and tear item. Arnold Clark are not very efficient. The first time we tried to book for the gear box fault, just a week after the warranty ran out, they told us we would have to wait three weeks to get a courtesy car. We live remotely so booked for a car. We went three weeks later and they had not got a courtesy car available, despite the fact that we had driven over 30 miles with a faulty gear box. We had to wait another 3 weeks, by this time of course, the warranty was two months overdue. Had we got the car in sooner perhaps we would have been just so near the end of the warranty we may have had a chance of a full refund.
When they finally took the car in and changed the gear box, they rang and said the car would be ready to pick up. However, we were in Dundee ready to pick it up whilst they were trying to get in touch with us at the last minute to tell us the wrong mounting for the gear box had been sent and they could not let us take the car. They wanted us to come back the next day and I refused. This was the fourth visit and petrol 60 mile round journey is more cost. We refused to come in and they reluctantly decided to deliver the car to us. They made us feel that we were at fault and that they were doing us a favour. The staff, certain staff, were very rude to us, impatient, and treated us badly. We wont go there again. We wont buy a Renault again and we will make sure that Renault buyers know that their gear box could well go wrong in three years. I will be seeking more advice as to whether we can take these people to court. We were more or less blackmailed into having to accept the fee of £585.00 otherwise we would not have a car or a courtesy car. If the engine blows meanwhile, do we keep on paying out for such a young car? The warranty is irrelevant according to trading standards. What is relevant is that the car is covered on the 1979 and 1980 act which covers the car for 5-6 years as being fit for purpose and if not, then it should be repaired free for major parts such as gear box and engine.
