Dear Mr. Collins,
This letter serves as formal written notice under Michigan construction standards that Rainbow Seamless is currently in material breach of its contract obligations regarding the shower installation project for Ron and Elizabeth Wilson at the address listed above.
THE PROBLEM & ATTEMPT HISTORY:
Following the initial installation of the shower unit in March 2026, the shower pan has remained unsafely defective. Over the past four (4) months, your company and your designated installers have been given ample opportunity to remedy this issue, resulting in three (3) distinct, failed installation attempts.
To date, you have failed to provide a safe, defect-free shower pan. Written and verbal logs substantiate the dates, notifications, and deficient outcomes of all three failed attempts.
MANUFACTURER ADMISSION & REFUND PROPOSAL:
On Monday, August 10, 2026, representative Josh Powell confirmed via verbal communication that Jacuzzi explicitly recognizes this manufacturing defect. Furthermore, Mr. Powell stated that Jacuzzi is unable to provide a defect-free alternative for this specific configuration and has formally offered to cost-share a full refund with Rainbow Seamless. We hold documented correspondence verifying this acknowledgment and the resulting refund proposal.
REQUIRED ACTION & DEADLINE:
You are hereby demanded to execute one of the following corrective remedies within five (5) business days of this notice, no later than Tuesday, August 18, 2026, at 5:00 PM EST:
Coordinate directly with Josh Powell/Jacuzzi to process, finalize, and deliver the agreed-upon refund to the clients, OR
Source and install an entirely non-defective, safe, and certified alternative shower pan that completely satisfies the original scope of work.
CONSEQUENCES OF NON-COMPLIANCE:
If Rainbow Seamless fails to cure this defect or finalize the cost-share refund agreement by the designated deadline, we will immediately pursue the following remedies without further notice:
We will formally cancel and terminate the contract for cause.
We will retain an independent third-party contractor to complete or remove the defective work.
All associated completion fees, labor rates, and administrative costs will be back-charged directly to Rainbow Seamless.
We will pursue legal remedies, including filing a complaint with the Michigan Department of Licensing and Regulatory Affairs (LARA) if necessary.
