Despite having paid approximately 83% of the contract amount, substantial portions of the contracted work remained incomplete. Throughout the project, I repeatedly tried to work with the contractor to get the job finished. Multiple completion dates and written schedules were provided, but significant portions of those schedules were not met. Outstanding items included electrical work, replacement windows, a bathroom vanity, trim and finish work, tile, painting/corrections, and other contracted and punch-list items. Some materials that had been paid for had still not been delivered. I also had significant concerns regarding construction cleanup. Drywall/sheetrock sanding was performed without adequate dust containment while the HVAC system was operating, resulting in fine construction dust throughout the home. I documented the conditions and ultimately had to arrange professional HVAC/duct evaluation and cleaning. I gave the company repeated opportunities to complete and correct the work. When the electrical portion continued to remain unresolved, I eventually hired an independent electrician so I could move the project forward. Even after additional written commitments from the contractor to return and complete the remaining work, consistent performance did not follow. On September 16, after weeks of documented communications, missed schedules, incomplete work, undelivered materials, and additional expenses, I notified the contractor in writing that I considered the contract abandoned and that I would have to move forward with other contractors to finish and correct the project. I have retained the contract, emails, photographs, videos, invoices, estimates, payment records, and other documentation related to my experience. I wanted this project completed successfully and gave the contractor numerous opportunities to make that happen. Unfortunately, my experience ultimately left me having to find other professionals to complete and correct work after paying the substantial majority of the original contract.
