They then send me over an agreement form along with requesting a payment without even speaking with me prior . I reached out to them and someone was supposed to call me back they never did . Be extremely careful with this law firm. Their CONSULTATION is purely a revenue stream. I have a very simple case with a Zoning Board of Cary for a Reasonable Accommodation request, and I have done all the leg work which the attorney confirmed. All I needed is legal representation for any unforeseen item and the firm insisted on consultation first for a fee. They took my money, and they are now telling me that they don't have resources to support me. I asked why they insist on consultation if they have no resources to take the case? read more

I had the most unfortunate and disappointing experience working with this law firm albeit in a very limited capacity. The buyer of my home chose to use this law firm for closing. I had my own closing attorney to process my side of the documents, but I still had to work with this firm for the settlement of funds. First, no one was proactive. I provided information weeks prior to closing which included my estimated mortgage pay off. I received my draft settlement agreement a few days before closing and my proceeds were astronomically short due to them having a completely wrong amount under my mortgage pay off. No one had gotten my final pay off from my mortgage company. This was their job to obtain this. Whoever was completing this agreement also listed a $300 charge for document processing. It was clear that Whitaker and Hamer did not represent me or process any of my documents as I had my own attorney. There was also a $150 line item for wiring of the proceeds. Fast forward to closing day (Friday), the house recorded at noon. I never received my settlement and my agent had not received her commission pay out. We agreed to follow up on Monday. I contacted the firm on Monday and the receptionist proceeded to tell me that the check was being sent to me via Fed Ex. This was absolutely not the agreement as I had already been charged $150 for the wire transfer. She recalled me providing all of my bank information for the wire, but it clearly did not get disseminated to the correct person. My option was to keep the check or have them void it and continue with the wire transfer. I clearly wanted the wire since I had already been charged for it. I received no apology or any suggestion on how this can be rectified swiftly since they clearly dropped the ball. I found the Fed Ex envelope in my front yard for a very large sum of money; however, no signature was required. This is a whole new level of incompetence. The firm stopped answering my calls, so I had my agent call them to figure out where the settlement was and why it had not been wired. I finally received the funds at 4pm. This was received 4 days late. The level of incompetence at this firm goes unmatched. I will never solicit any kind of legal services from this group and my agent has included this firm on a DO NOT USE LIST. I would highly recommend against using this firm for any legal needs. If I could, I would give negative stars. Do better people! You charge a lot of money for these kinds of services. The least you can do is play your part. read more

I recently closed on my property, and Whitaker and Hamer were representing my buyer. While I understand that this firm didn't represent me, they still were responsible for handling over 100K, paying off my mortgage, etc. They made it very clear that they didn't care if this was a good experience for me, because while they were interacting me, they were not representing me. I understand this on a fundamental level but not really because I think a company's values should be consistent in a community because they were still providing a service. I believe this mindset actually led them to compromising their own client's personal data and a lack of professionalism overall because what if I had wanted them to represent me in the future (LOL). Ironically, if they had a community based mindset I doubt this experience would have happened to me and they wouldn't have let me see other's personal documents. I think this mindset is also why North Carolinians are tired of getting services from providers in Raleigh that are inconsistent with their values when it serves them and treat people like numbers rather than members in their community. When I arrived at 9:45am, the front desk lady assumed I was there for a different closing and provided me with personal financial information that was not my own. She had already taken and scanned my ID, yet I had to be the one to tell her this was not my information. This immediately put me on edge as someone trained in how to store documents. She then told me I needed different documentation then what had been communicated with me via email. At first they didn't believe I had been told differently until I pulled up the literal email about the proceeds in front of them. I talked to several different people at the firm and they told me different information on what documentation was required to be notarized and what original documents I needed in person. I live out of county now and so does my cosigner and I had to drive to get several things notarized. Part of that was on my own attorney for not notarizing things and I'll take accountability for that one that's not on them. However, when I got back the front desk lady and I asked if they sent the documents they needed to me and my cosigner she asked ME if I had sent the legal documents to myself and my co-signer.... How would I when I'm not the attorney and ya'll are the law firm with the documents? How would I have a docusign account and you the person working there does not... Then she was like well I don't know... then why are you telling me information with authority... So at this point I felt like I was working with people who may have just not been trained. I was trying to give them the benefit of the doubt that this wasn't just wild incompetency. After expressing frustration and also concern that my documents were not being handled properly, they didn't want to review the documents with me because they weren't representing me. Again, I understand that's not part of your job description. HOWEVER AGAIN, if you've mishandled and miscommunicated this many times and someone now doesn't trust that you can do your job in regards to this much money, then maybe respond with professionalism and sit down and hear their concerns. I had to drive from the Raleigh to Garner office for someone to finally just review this information. I ended up having to cancel basically my entire day and I don't get PTO like these people probably do, so if you work with these people please note they believe that their time is way more valuable than your own. I'd recommend this place get a structured documentation process to avoid confusion moving forward and possibly train your staff. I also would recommend this place get training in how to communicate with neurodiverse people. I'm autistic/ ADHD and I consistently felt spoken down to by staff and like I was being treated like I was being difficult and like I couldn't read or understand. This review is for my interactions with staff at McCullers, Whitaker & Hammer, PLLC on the dates of June 13 through June 26, 2018. Work provides me a covered legal services benefit through ARAG, who referred me to Attorney Joshua Whitaker for a simple review of a Lease and Guarantor Agreement. Unfortunately, I cannot recommend working with Joshua nor Attorney Ashley Pinner because they both are unresponsive or slow to respond. I initially reached out to Joshua by phone and left a transcribed message with one of the telephone receptionists to have him reach out to me to discuss my engagement, but received no response. Subsequent emails I sent were either responded to without urgency or did not receive a response: - I sent an email on June 14 that Joshua replied to on June 18, - I replied on June 18 with an ARAG coverage confirmation of service and sent another reply on June 20 that received a same-day response from Ashley, who asked that a different ARAG coverage confirmation be sent. I replied again same-day. - I did not receive any reply to the second ARAG coverage confirmation that I sent on June 20, so I followed up again on June 21 and received a reply on June 22 from Ashley that she would follow up with ARAG directly by June 25. - I followed up the afternoon June 25, but did not receive any response. - I followed up with ARAG legal services benefit on June 26, who confirmed that no one from MWH Law called their office; I sent a final communication on June 26 to cease our engagement. Despite my best attempts to reach out and work with the attorneys, I received with no response or they were slow to respond. I took them 4 hours to electronically file a deed, which kept another closing from happening. The other closing attorney and I kept trying to call, but only connected with the answering service. Finally I called the Garner office and let them know. Then the deed was filed and the wire was sent. Very unprofessional and unconcerned. The office wasn't busy at all, and I understand why. This is the 2nd closing that I've run into this attitude of indifference. I will continue to use any other attorney, rather than this firm. They may be cheap, but that's what you get. read more

Horrific experience during a home closing. We signed paperwork on Thursday for funding the following Tuesday. During the closing, the attorney acted like she had better things to do. As of 2pm on the Tuesday, the firm still had not sent our documents to the lender for closing. The lender had to return documents to the lawyer once they finally received them for corrections. We were told the check would be ready at 5pm. It's now Wednesday and the check still isn't ready. This firm is horrible with communication and does not complete tasks in a timely manner. Do not use this company - their lack of communication is absolutely horrible. They waited until the day before closing to present information that could delay it that they acquired days before, and also refused to take the proof that was presented. We chose another closing attorney that was successful in getting what was needed and they then interfered with the closing of the sale. Use someone else. read more

Not only is Josh Whitaker one of the nicest people you can meet, I've always found him to be trustworthy, have a good sense of humor, and have compassion for his clients' issues and needs. I've worked with Josh in real estate and recommended him to others for civil matters as well. Josh's staff of attorneys and paralegals are some of the best people to work with that I have ever encountered. Josh understands the area, his clientele, and has a depth of knowledge on just about every legal subject I have approached him with. Regarding the previous review stating Josh is hard to get in touch with; I find this hard to believe. He has always been extremely responsive to me, but in the even that he is not able to answer me directly, he is prompt with delegating tasks to his more than capable staff. I suggest everyone consider Josh's firm for their legal needs; their firm is upfront, honest, responsive, and in my opinion is affordable. read more

The attorney made a mistake in our case, refused to admit it and got hostile with us when we questioned his behavior. Save yourself the headache and do not hire! Our lender called us a week out from our closing date concerned that their offices were being non-responsive. This was the first indication of the problems to come. On our closing date, we went to their North Raleigh office, finished signing all of the documents we were given, but when we asked for the keys to the property, McCullers seemed surprised by the question and stated he *thought* they were at their Clayton office. Confirming so required multiple phone calls on our part (McCullers provided no assistance), and we ended up having to drive to the Clayton office to pick them up. After returning home, we were called by the North Raleigh office asking us to return to sign one more document. It was in fact two documents that they had failed to present to us. They blamed our lender. Altogether, they added at least 2 1/2 hours of drive time to our trip. This firm suffers from a lack of proper communication and severe incompetence. read more

This firm has a great price for handling a buyer's closing, but I can not recommend them. I am a Realtor and have been through many closings. My buyers only had their deed recorded on the day of the closing because the lender got involved. In all fairness, we closed on the last day of the month so the firm was busy. But the firm's representative came to the closing without the Alta document so it went unsigned - we were told it was not necessary to record the deed. Three and a half hours later there was a mad dash by the closing firm for all parties to sign the ALTA so the deed could be recorded. Checks to the parties were not mailed out by the firm until phone calls were made some 5 days later. read more

This is by far the WORST law office I have ever had the misfortune to deal with. I warn you do not use this office for anything other than a simple will. Joshua Whitaker can take weeks to return a simple email, and forget getting him on the phone. There is always a "family emergency" in the office and even if you do manage to make an appointment they can and will simply call back the next day and cancel it. I have had an issue that they told me was simple to resolve...that was almost 7 months ago. This office actually give lawyers a bad name. Stay away. read more

Absolutely the worst experience! When you expect to see an attorney, one expects someone at least dressed the part, not in cargo pants and a polo shirt unbuttoned and an unshaven face. And then the first sentence out of their mouth is "man it's hot as shit in here". Completely unprofessional. On top of that, they schedule 7 home closings one after the other, even after they were informed that a certain closing had issues and would require extra time. During this closing, the attorney was aware that there were issues and was noted to say that "it was not part of his job" even though the issues that were brought to attention were in the legally binding contract he was overseeing. All this after collecting his nice $338 fee. We, nor the real estate firm will use this group in the future thanks to one of the partners. And, grievances are currently being filed for these issues so that hopefully no one else will have to deal with this. read more
