In writing this story I am a retired nurse practitioner and workers compensation nurse with over 50 years' experience, so I know how the Florida workers compensation works. The employers' workers compensation insurance carrier is hired not necessarily to help the injured worker by to minimize the treatment costs and obtain an early release from care based on cost savings. Some insurance companies work with physicians who will minimize care for injured workers because these physicians feel some injured workers are exaggerating their symptoms and it is a quick way to make money. These physicians should be ashamed of themselves as we have met plenty of them. This is the story about how and why we found and hired Mr. Kenneth Schwartz. Without Mr. Schwartz the injured worker would either be wheelchair bound or possibly would have died. A close relative suffered two work related injuries, August 1999 spine injury from a holdup and March 2021 hand and neck injury after 33 years at the same trucking company. The injured worker suffered low back pain since 1999. The insurance carrier sent the injured worker to their so-called pain management physician who had no certification on record for pain management or physiatry who provided epidural injections that eventually caused spinal stenosis. March 2021 the injured worker suffered a cervical neck herniation with extrusion in addition to a hand injury that caused severe unrelenting swelling and pain. The insurance carrier chose an orthopedic spine surgeon who prescribed physical therapy then discharge the injured worker. The insurance carrier chose a hand surgeon who minimized care discharging the injured worker after completion of hand therapy even though the hand was severely swollen and painful. Due to ongoing neck pain that radiated to the hand the physician ordered a neurological consult that the insurance carrier denied. Despite low back pain, difficulty walking, neck pain and hand pain the injured worker was released to work July 2021 the same time Mr. Schwartz was hired. Mr. Schwartz observed the swollen painful hand requested a second opinion hand surgeon who provided conservative treatment. December 2021 the neck and hand were reinjured rendering the injured worker out of work. Mr. Schwartz made sure workers comp payments were made to the injured worker. Mr. Schwartz made a plan for a second opinion addressing all the problems that caused the insurance company to take responsibility for the injuries. Due to Mr. Schwartz the hand surgeon performed carpal tunnel release surgery that relieved the severe pain. What a blessing the hand surgeon did the proper treatment. The low back pain became so intense the injured worker lost the ability to walk and became wheelchair bound. The insurance carrier pain physician performed an MRI that revealed the spinal fluid could not reach the lower spine telling the injured worker he needed to lose weight. Mr. Schwartz agreed the injured worker should be seen for a second opinion at University of Miami Neurosurgery who diagnosed cauda equina and recommended surgery. Mr. Schwartz played an integral part in getting the insurance carrier to cover the spine surgery, rehabilitation with physiatry. The injured worker continues to have low back pain with little relief, walks short distances but requires a walker for longer distances. The insurance carrier chose their pain management physician for low back pain who prescribes minimal medication for round the clock pain instead of a physiatrist. Mr. Schwartz has suggested settling the case in order to obtain proper care from a physiatrist who knows how to treat the long-term pain and treatment caused by cauda equina. Again, the insurance carrier has failed the injured worker by not approving a physiatrist. From day one Mr. Schwartz has been available twenty-four seven within minutes. Mr. Schwartz is never too busy to have a conversation or help in any way. Mr. Schwartz thrives on a challenge and gets to the end goal. Mr. Schwartz has back-up plans to his back-up plans. Mr. Schwartz explains the pros and cons of a situation, is not paternalistic or condescending. Mr. Schwartz explains in plain language for the injured work to understand. Mr. Schwartz listens and explains the rationale of a situation or process. Any time the injured worker needed something be it equipment or treatment, Mr. Schwartz has been the advocate, is workers comp gold standard attorney and is the one to choose. We cannot say more good things about Mr. Schwartz except thank you for accepting to represent the injured worker.
