Our experience with Mrs. Sliva was horrible. She took our money our money and now we have had to file a claim with small claims court since she refuses to give us our money back after we gave her chance after chance. This has been going on since 2009. She kept threating to file bankruptcy if we sued her. At the time her business name was Budget Tombstone. After doing research she has had several company names and I am sure it's because she keeps getting sued for her lack of communication and lack of good customer service. Every family that has lost a loved one deserves to be dealt with dignity, respect and be given straight and honest responses. My husband contacted "The Cemetery Store" to purchase a headstone in the fall of 2015. He communicated via email and telephone with Sherry to arrange payments on a monthly basis. As soon as all payments were received she stopped answering the phone. He sent her a text when "The Cemetery Store" aired on Fox News on October 11, 2016. He asked her to delivery the headstone immediately. She replied that she had to take care of family members in hospice and one had just died. She told him the headstone takes 4 months to come in and she would order it in December before the price went up in January of 2017. That was the last time he heard from her. After not hearing back from her, he texted asking her to deliver by February 28, 2017. If not, please cancel his order and refund all of his payments immediately. She did not respond at all. The Cemetery Store has violated the Texas Deceptive Trade Practice Act by conducting false, misleading, and deceptive business practices toward its consumers. The Cemetery Store advertised goods, received complete payment from the consumer, and failed to sell merchandise as advertised. As of January 2018, many families who have lost love ones have fallen victim to your false advertisement and deceptive practices. You have breached every promise you made to these families at a time when they were already going through a grieving process over the loss of their beloved family member. You had no respect for life nor death. This is pure evil and justice shall be rendered. "Whatsoever a man soweth, that shall he also reap." There is absolutely no excuse for your actions at all. Then months later trying to explain to family and her son why I have not received the headstone. Going on an entire year and she stop emailing or calling me. You failed to mention that my family had fulfilled our "layaway" commitment 14 months prior to filing our complaint with the Harris County DA and the State of Texas Attorney General. You made ridiculous and unbelievable excuses for 14 months in order to avoid fulfilling your obligations of our business contract. The excuse that the "town cemetery was never paid" is a lame excuse, the cemetery in Wharton, TX was never a partner in our Contract. The cemetery was prepared to receive my father's headstone if you had followed through with your contractual obligations. Your hopes were that my family would pursue restitution through the Small Claims courts system which you knew is a dead end solution for the customer.
