My initial complaint drafted by Dan Seigel was dismissed by the Judge because it did not have the…read morenecessary facts included. Dan's response to the Court? "But this is the same complaint I always file." That is him in a nutshell. Charging far too much for boilerplate pleadings. I provided all of the facts necessary to write a detailed complaint - he included virtually none of them. And when I asked why, he told me, "I do this all the time," and shut me down. I spent thousands of dollars only to have my complaint dismissed and then I had to start all over again - and pay him for it all over again. No apology, no discount for the amended filing, nothing. In Court he was easily rattled and made poor arguments; in one hearing he actually argued the Judge out of ruling on our behalf. On two of his five invoices he billed me at the wrong rate (higher than agreed upon, of course). When I pointed this out to him, he was curt and defensive with me. And when I fired him and found a new attorney, Dan contacted that new attorney five days after sending his final invoice to ask if he was going to get paid. His rate was 50% more than every other attorney I contacted, and while he advertises "concierge service," the only thing concierge about his service was his price.

Once the Act was passed he was impossible to reach by phone or email. He retraumatized the victim by promising to write a request of settlement letter to the school my son was abused in. Week after week I explained to him that my son was having a hard time reliving that time in his life and was seeking closure through legal means. Something Mr. Mermelstein had promised to try to provide. Repeatedly Mr. Mermelstein lied to us about writing the letter and moving my son's case forward. When he finally responded he had his associate Krisel send a "letter" that could have been written by a middle school student with many wrong facts - the most negligent being that she named my son as the perpetrator of these awful acts and his abuser named as the victim. I don't think unprofessional is a strong enough word for this firm , more like malpractice. Mr Herman was kept apprised along the way and was complacent in the poor treatment we received.They wasted precious time that my son could have been using a law firm that cared. I would not recommend using this firm if you want someone who cares at all about the victim. I believe their actions would not be in line with what is expected of a member of the Florida bar association.
