We paid $3,000 to Yancy Burnett for representation in a case involving the Indiana Department of…read moreChild Services. Our experience with him and attorney Mitch Steele in his office left us feeling worse off than before we hired them: we are out $3,000, and seven additional months passed before we learned they would not pursue our case. We understood from the beginning that this was a challenging case, including potential statute-of-limitations issues. We still understand that getting into court would not guarantee success. We expected a serious effort to explore the available legal options and a clear explanation of their assessment. We supplied the records they requested. After that, we received no contact for several months. I finally reached out to ask what was happening, and only then were we informed that our case had been dropped. During those months, neither attorney contacted us with questions or sought clarification to better understand the records we provided. We handed over the documentation, heard nothing for months, and learned--only because we asked--that they would not pursue the case. We believe we have substantial evidence of misconduct by DCS that deserves examination in court. We also believe depositions and court-ordered production of records we maintain have been withheld could uncover additional evidence. In our view, the evidence and the opportunity to obtain further records gave this case meaningful potential, including the possibility of a substantial settlement. We understood that filing alone would not guarantee that outcome, but we wanted a serious effort to pursue that opportunity. To our knowledge, no contact was made with the Indiana Attorney General's office about our case. I contacted that office myself after the representation ended. Although my request was denied, we received no explanation of whether they considered that avenue or why they decided against it. I cannot say how thoroughly our records were reviewed or what work occurred behind the scenes. But no attempt to get our case before a court was communicated or explained to us. The lack of communication and the time that passed left us feeling deprived of a meaningful chance to pursue our claims. We requested a full refund of the $3,000, and Yancy Burnett refused. Had he declined the case at the outset, we could have used those seven months to seek other representation. Instead, we lost both money and time in a matter where the passage of time was already a central concern. We knew this would be difficult. We expected him to try, keep us informed, and promptly tell us if he would not proceed. In our experience, those expectations were not met. Based on our experience, I would not recommend Yancy Burnett or Mitch Steele for a complicated case.
