    DO NOT UNDER ANY CIRCUMSTANCES HIRE THIS CONTRACTOR!!! To…read morebegin with he does not have the financial ability to complete the job. The contract stated 50% upon signing and 50% upon competition. Almost immediately after beginning the job he started requesting draws against the final payment in order to meet payroll. All in all he made 5 draw requests, which I mistakenly granted, totally $6,800 against the $7,850 final payment. Next, he either does not know how to bid a job or deliberately underbids to get the job and then starts making excuses why he cannot do the job for that amount after the contract is signed. We signed our initial contract for $14,900 which was to include a parking retaining wall, railing for a walkway, a concrete patio with walks with a built in firepit. On his first day on the job he stated he didn't correctly evaluate the slope of the backyard where the patio was to be installed because it was raining that day. Because of this he has to build a retaining wall and stairs to do the job. Now the price to do everything was $19,900. We therefore decided not to do the parking retaining wall and move the $5,900 to the patio retaining wall. The revised price was now $13,900. Then he informs me the patio retaining wall will be over 3 feet high. I questioned him about needing a railing on the patio due to the height when he did not recommend it and he agreed I should. Now the price was changed to $15,750. Next, we sent him a design drawing on how we wanted the patio, rectangular. He then built it with curved corners. When questioned he stated that the retaining wall blocks he used did not allow for the wall to be squared off but had to be curved. This was a lie as I've since had 2 independent contractors tell me the block used can be installed in a square design. Then the steps he built were not to design and the most grievous problem is that one step not only has a upward slope to it but it also has a slant to the right whereby the next step has a 12 inch step-up on the right and an 8 inch step-up on the left. The patio was also to have the concrete stamped which it is not. He blamed the rain we had when he was doing it as the reason and that because of the weather he didn't have to redo. Finally, and the greatest problem of all was the patio railing. He installed the railing without first gaining approval of the post location in such a manner that we lost almost 50 square feet of patio space. He had concreted them in and we had to have them cut 2 of them and relocate. Initially instead of using a bracket to secure he glued the wood post to the concrete. I insisted on a metal bracket, in which he again simply glued to the concrete. He stated the glue he used was to hold 5,000 lbs. I told him I wanted concrete mails / screws for added support. He stated it would crack the block but I insisted. Instead of using the concrete nails / screw he used regular wood framing nails. Needless to say, the next day I was talking to another contractor and was leaning against the railing when both the railing and post collapsed and I fell. When I informed him of what happened he ignored the rail/screw issue and insisted it was my fault because I didn't let the glue cure for 24 hours (it was 20 hours). Both the contractor who was here when the incident happened and a friend of mine who flips homes stated that glue should never be used to secure anything to concrete, IT'S NOT TO CODE!!! This contractor is taking no responsibility and remains firm in his position that he did a good job and that it is my fault. He never offered to return to fix and I wouldn't want him to anyway. I've hired another contract to fix the stairs and railing and will use him to testify in a lawsuit I intend to bring against Ervin Smith and Smith Outdoor Solutions.
