Mr. Toole was the lawyer she used to set up her trust. The trust and will were set up and reviewed…read morea few years ago. I don't think that this firm specializes in setting up trusts. Not only were a number of things left out of the trust--like cars and property--but at one point they gave my mom's investment company the wrong trust name for two accounts. A trust set up properly should have taken 4-6 months to close. Instead it has taken 15 months and still counting. And it has cost me $20,000+ in lawyers fees. I had to go through probate for the cars and properties not in the trust. And we had to go through hoops to see who the mistaken trust name was supposed to be for. Also, the beneficiary of the annuities was the trust (fortunately one had me as the contingent beneficiary). This isn't always a good idea since the annuities would have to be cashed out rather than transferred and then dispersed over time. This created an unnecessary tax burden. So things were in the trust that probably shouldn't have been and other items were not in the trust that should have been. Perhaps that was not on Mr. Toole's advice. But wouldn't it be his responsibility to discuss the implications of naming the beneficiaries for the annuities and IRA? I went to a lawyer in Portland who specializes in trusts. He was so efficient, he gave me a small laminated card with the name of the trust, a notebook with clear sections, instructions on how often I need to review and reautherize the trust, and forms explaining how to put all my property in the trust--except for annuities and IRAs.
