So this is my first time hiring a K9 Training Service. I had decided to go with Off-Leash Training here in Columbia due to their 5 star reviews. I called and spoke to a man over the phone. He took a payment of $279 and some change to start lessons and order the collar. Almost a month went by before I was even able to start my 1st lesson. I expressed my uncertainty to my trainer but we talked it out and it was smooth sailing from there. We did the 1st lesson, and when she asked me about scheduling a 2nd lesson, I inquired about the price as I had other payments to make. Would've had to wait a week. My trainer informed me that I had paid for 4 lessons, so we met up and did two more over time. On my last lesson my trainer told me she was going to California for a couple weeks. Told me she could have one of the other trainers contact me about our next appointment. I told her that it was fine and I could wait until she got back to schedule any more.
Today I woke up from a nap and had received these messages from their business. Accusing me of deceiving them and demanding I make a payment of $237.50 today. No exceptions. I screenshot my bank statement and told him I don't have the money. That if he wants me to make this payment, that he would have to wait until Wednesday when my check hits -- a day late due to a national holiday. So he told me to have it my way and that he would file a police report. I expressed that I was very ashamed and disappointed with these services, and he told me that this is the fault of me, not him or his independent contractor. I explained that I haven't received any prior invoices from the business for payment. Repeated that my trainer had told me I had paid for 4 sessions, and that it should be the independent contractor/employees responsibility to report to the business when they make these appointments. Not the clients. I told him that if he wasn't willing to accept the payment Wednesday that I would contact a lawyer and provide proof of these messages. He told me that my agreement was with him, not my trainer, and sent a photo of the order he'd made 4/27/22. I then explained that I am also an independent contractor that works for a business, but that it is my responsibility as the contractor to report to the business when a client needs to be charged.
Frank then said, "As I mentioned. The payment is due today. If no payment is paid for the services your deceitfully acquired knowing you wanted to pay per lesson, I'll file the police report. Should a payment in full be made... that would be a good move on your part. I'm done with this conversation and excuses."
I did tell him that I wanted to pay per lesson as the entire thing costs $625, but I didn't know what was included in the first payment as it was the largest charge. So when my trainer told me I had 4 paid for, I didn't think anything of it.
I told him again that I would be contacting a lawyer, and he shot back at my statement of being an independent contractor and said he had specifically told me to contact him for my 2nd lesson. I only spoke to this man over the phone. I have no emails, messages, or signed contracts with this business stating anything. This was apparently just a verbal agreement that I had forgotten, as my trainer messaged me personally each time to set up our appointments. This is, again, my first time hiring a service like this so I am not educated on how I'm supposed to report to this business when I'm the client.
Each time I had spoken to Frank on the phone other than the first time, it was during my work hours while I was busy. The last time I spoke to him he called to inform me that my trainer was moving out of state, and offered a trainer that lives south of Jefferson City. I was at work and I told him I would have to think about it and contact him at a different time. He proceeded to message me today that when he called me June 25th, he had mentioned setting up for my 2nd appointment and tried to hold me responsible for not correcting him that I'd done 3. While I was distracted at work trying to get off the phone because I was unsure of if I even wanted to continue services with them.
At no point did I refused payment. I just told him he would have to wait 2 days to receive it due to the national holiday and only having $113 to my name. Frank insisted on filing a police report for "theft of service" and continued to demand the payment be made today. Told me to "take some responsibility and stop blaming everyone but yourself for YOUR actions! Especially when you did lesson 3 just 4 days prior my me calling you!" when it is in fact his contracted employees responsibility to report to their business when they've done their job. Not mine.
