Let me provide some insight into NextHome Realty. We used listing agent Lindsey Emmons to sell our house. Lindsey was nice enough and hard working at first. After all, she lived in the same neighborhood. We ended up selling our house and then renting it for a month from the new owners. Lindsey said she negotiated for us to pay on a per diem basis and if we moved out early, we got a refund. I asked if we had that in writing and Lindsey said "Yes".
At the closing of selling our home (4/30/18), I was presented a set of closing documents and then 10 minutes later another set of closing documents with different monetary figures. Just my luck, my blood sugar was low and I was confused. I said something doesn't look right with the real estate commission fee. Lindsey said, "It's ok I already looked over it". I said I would have to look over it later. At the time, I was moving and my wife was in and out of the hospital. It was after the closing and the Real Estate Commission paid that things were not the same anymore.
When I found out I was overcharged, I contacted Lindsey who said she did not have anything to do with the closing figures. I contacted the title company that said Lindsey did indeed give the title company the closing figures. I provided that information to Lindsey with no response. At this point I was already on an email only information exchange so I had a written record. ( And still do). Another two weeks and I emailed Lindsey again saying I was losing patience. She said that I may be threatening (LOL) and it may not be in her best interest to talk to me. I then provided Lindsey the information from the title company and Lindsey said "What do you want me to do, it has already funded". I said I was owed a refund. I was then told a check was in the mail for $1400.00. Two weeks later when no check arrived, I contacted Jennifer Jennings the Broker.
I sent Jennifer detailed information on the whole thing, the amounts, that I thought Lindsey breached the fiduciary relationship at closing and asked her for a professional solution. No reply. I then called Jennifer sometime later. Jennifer said yes she got the information. Why did she not reply? Jennifer said that she had gone to the title company to pull the documents. She disputed the overcharge and the amounts and we went back and forth. I was sent information with convoluted percentage formulas showing they did not owe me $1400 and that I had signed the documents on line such and such. I kept asking myself, How can a reputable business continue to operate in this fashion and stay in business? I thought, oh, they are going out of business and I will never get my money. I then went down to the title company and talked to the supervisor who got the closing agent to send me information showing that NextHome did indeed owe me $1400.00 for overcharges. I sent this to Jennifer. It was then that they decided to pay me MY MONEY.
I never got my per diem refund for moving out of my house early. Lindsey said, "that was between me and the new owner."
Took 2 months and three days of my time and frustration to get MY MONEY refunded. (received check 8/11/18)
Jennifer never addressed the closing breach of trust and never even said "Sorry Mr. Client" for the mistake and all the trouble.
They got their Real Estate Commission on the new house I moved into without ever seeing the house itself or showing up at closing.
