We attempted to purchase a property through Marius Kasniunas and the Century 21 Affiliated Pro Team…read morein Palos Park, IL. We specifically wanted a two bedroom/ two bathroom condo with a garage. Marius showed us a property listed through his C21 office's website as having a garage and assured us repeatedly that it did have a garage. We signed the contract and proceeded with the deal. The day before closing Marius called the condo management company and learned the garage had been sold in a tax sale a few years ago. Marius and his broker manager, Donna Shelton, have passed the buck and refuse to take responsibility for their mistake. All it took was a five minute phone call to confirm the garage, but Marius failed to do his due diligence earlier in the deal. We are now forced to file a lawsuit to obtain a resolution to this matter.

If a realtor would do this to a friend, imagine what they would do if they were not your friend. I think the larger corporate real estate offices are more worried about volume than they are the price. The sell so much they don't care about pricing a home cheaper than what it's true value is. If you do the math, they don't lose that much commission selling a home $10 or 20k lower than its value, especially if they sell a lot of homes. Originally, I had asked my realtor friend to list my home for 160k and she said her office won't list homes priced over the market. I ended up listing my home with her office for 149k even thoughshe kept telling me and showing comps where my home was worth $20k less than what I made her list it for. My home sold in one day and my lawyer advised me after closing my home appraised at 155k. When I reviewed the comps my realtor used, approx 95% of them were 600 sq. ft. smaller than my home. My realtor did not represent me in any aspect of the contract and in fact, it seemed she was more worried about losing the buyer than protecting me. If I had listed my home using the comps she used, it would have cost me money to sell my house. After we had various heated arguments, she sent me an email saying I was selling my home $12k over the recent comps in my area, which by the way, tells me her office does take listings priced over the market. She also noted the buyer was taking the risk of purchasing a home with a bad foundation or electrical. The buyer's agent forgot to list the appliances on the contract and my realtor called me and told me I had to check the boxes for the appliances. When I told her I did not have to because they already signed the contract, she said I had to because I noted in the listing agreement I would leave them and she insinuated I might lose they buyer. Well we all know everything is negotiable and just because I noted I would leave them does not mean I have to if they are not asked for. Otherwise it wouldn't be an option in the contract. Could not figure out why she was so worried about the buyer except for the fact she would lose a sale. All they needed was a home inspection to satisfy any worries they had. I don't believe the buyers were the one with the worries! There is so much more to her mismanagement of my home sale to get into but I would never use this office. Always check Zillow.com for a more accurate pricing of your home or have your own appraisal done. I think realtors today are in competition with short sales and foreclosures so they price your home lower just to make a sale. You can't compare a beautiful home to a short sale with plumbing torn out or worse!

He also listed the house at a price that I thought we could not get. The house was older and dated and needed a decent amount of work. He was helpful in the overall process from listing to managing the offers. The process was difficult as the first buyer was not approved for a loan and we had to relist. He was on top of things the entire process and gave good advice during the negotiations. After four months, we were able to close with a second buyer just as winter was hitting. Incredibly happy with the outcome. Great work, Jack!
