After deciding not to move forward with him, he recorded a Notice of Interest (NOI) against our property even though only one of the owners had signed. His own contract clearly referenced another "owner of record," and he was also in communication with our probate attorney, so he knew full well that another signature was required. Even after the NOI was recorded, our family continued to communicate with him, and he was reminded that there was an additional owner; yet, he still refused to release it. This was nothing more than an attempt to hold our property hostage and keep it under his control. At one point, he even tried to renegotiate the price down by $120,000, using the NOI as leverage. He then ignored calls from us, from the title company, and from other agents, dragging the process out and creating unnecessary hardship. To make matters worse, he did not make it clear up front that he was a licensed Realtor®. By presenting himself as simply an "investor," he positioned himself to take advantage of sellers without the transparency and standards expected of licensed professionals. If this happens to you: File an ethics complaint with the Miami Association of Realtors. Report the conduct to FREC (Florida Real Estate Commission). Submit a complaint with the Better Business Bureau. Contact the Florida Attorney General's Office.
