The new order found that the trust company borrowed against the minimum stockholder's equity to buy out a partner in the trust company. The commissioner directed the trust company to provide documentation to show that the loan had been repaid and that it now had at least $300,000 in minimum equity. Kondrup also ordered the trust company to get an independent accounting firm to provide audited financial statements within 45 days and new audits by an independent accounting film yearly. My wife and I retained Sterling (and unwittingly his team of 29 year old newbie nit-wits) for a case involving our HOA At first, Sterling was full of confidence, promises and assurances to take our case all the way to trail as we assured him it would go that far. When the case went to mediation he didn't show up at all and instead sent his 29 year old just-out-of-law-school lacky Stacy. She screwed the whole thing up. Stirling later said he was sorry... Whatever. Then, at the deposition he, once again, did not show up and the 29 year old attorney he sent in his stead was no match for the opposing shark who deposed me. After that incident, and $25,000 flushed down the toilet, Sterling and he kindergarten attorney's begged us to settle for absolutely NOTHING! NO KIDDING! The HOA offered to drop the case so long as we pay our lawyers they would pay there's as well and it would be done. But, the HOA forced us into this and we felt it only right for them to pay at least the cost of our lawyers. Stirling, knowing he would gain no more money should he reach this settlement, decided to give up. He told us, when we very first met with him, it would cost us $25,000 to get the case through trial and we were sure to win at least that much, plus damages, from the HOA. Then, months later, he continued to ask us to settle for NOTHING, giving him $25,000 and leaving us in the lurch. At this point my wife and I began asking him why we would settle when our case is so strong and he stated that we have no witnesses. "Well, how about the HOA employee who has written testimony the accuser said she was going to kick my wife's ass?" I asked. "I didn't read that. What are you talking about and what's her name?" he ignorantly replied! We were both dumbfounded at his lack of knowledge. WTF does $25,000 buy? Not even basic understanding of the case he was hoping to settle and not actually ever study! Stirling, after $25,000 and months of "service", didn't know ONE THING about the case! He promised us he'd take it to court but begged us, with no knowledge about the case he was sitting on, for us to SETTLE SETTLE SETTLE as it was NEVER his intention to take this to court at all! We told him to pull his head out of wherever it was and read the case because we STILL wanted this to go to court and win! He then simply quit!!! Stating that he believed in the case but "just wasn't feelin' it" ... NO KIDDING THIS IS WHAT HE SAID! So, Stirling Kerr took our $25,000 before even deposing one person or the going to court at all! He quit when we told him we would not settle (settlement terms were a JOKE, btw) and recommended another attorney. The day after he quit was the day of hearing which he did NOT attend nor did he even tell us about the court date or hearing at all so we didn't even show up! We called the state bar and we will be seeking to register an official complaint against him and be demanding a significant fee settlement as well. We are also trying to check into legal malpractice options as, from how it looks now, Kerr has really hurt our case in progress. We trusted him from our first meeting as he is Mormon (LDS) as I and speaks Chinese (very poorly) as does my wife (natively). He comes off professional and sincere but spends all his time at his vacation house in Montana and has no real interest in helping his clients ... his only interest is purely in collecting fees and then dumping you (quitting) at the first sign that he will actually have to do any work. We even came up with a reasonable agreement and contract we both signed and paid him what was due. Now two years later nothing has happened; he didn't work on the case to push it through the court and he won't follow through on the contract and wants to change the agreement to get paid more.
