    We purchased a home and Mr. Kyle Zimbro (a relation to Kathy Zimbro) served as the seller's/listing…read morebroker. During the negotiations between our broker and Mr. Zimbro (and following buyer's/our home inspection), Mr. Zimbro made a misprepresentation (to our broker) about the water pressure (i.e. claiming the high water pressure reading was the correct pressure reading for a mountain community). This flatly contradicted what the home inspector stated and an expert retained by me confirmed, thereafter. Because Mr. Zimbro failed to communicate with our broker, we never had an opportunity to request that a new water pressure regulator be installed (or even to pay for it ourselves and have it installed while the former owner was in the home). When requested to substantiate his assertion in writing (i.e., from an independent plumber), Mr. Zimbro failed to respond to us/our broker. There were several other issues that cropped up (as is typical in a real estate deal), however, Zimbro simply would not return calls to out broker and failed to communicate with us on many other negotiable issues prior to closing. Time after time, our broker was stymied by Mr. Zimbro on requests to clarify concens presented by the home inspection and updates re: timing of seller's need to install a septic tank prior to closing. Much to our (and our broker's) dismay, he simply wouldn't return calls with follow-up answers to questions during the various counter-offers made in the process. He used various excuses... even claiming (according to our broker - a highly reputable real estate professional) that he wasn't able to get timely communication with the seller (who lived in the home just 20 minutes from Zimbro's Office). In our opinion, Mr. Zimbro's failure (several times) to timely communicate with us (through our broker), including rebuffing our request to meet in-person to iron out last minute issues (including seller's move-out date) was a clear failure in his duty of care as a licensed real estate professsional... a blatant effort to protect his fee. Similarly, our experience with his afiliate, Coldwell Banker, Touchstone Escrow in Victorville was also a bad (read, they are unprofessional) experieince. Judith Cuilty of Touchstone was absent-minded and on two occasions failed to convey important closing information to Theresa Schiaretti (the acting Escrow Officer). Schiaretti, albeit a pleasant woman, shined us on during the closing and, after she said she would communicate directly with Mr. Zimbro our request for a meeting (prior to closing), she indicated that she'd communicate our request and he was refusing to meet with us. Despite Mr. Zimbro's unprofessionalism and the ineptitude of the staff at Touchstone Escrow, we closed on the home due to personal circumstances (including having sold our only other home). We believed that we could bring our concerns to the attention of the principal at Touchstone and he'd make thinks right. Nevertheless, after finally setting up a telephone meeting with Mr. Jason Lamoreaux of Touchstone to convey our concerns about Mr. Zimbro (including his misrepresenation) and, he blew us off/ and the conference call/meeting, entirely. Moreover, his administrative staff (the gentleman who booked the meeting) never called to reschedule, or otherwise. As former licensed CA real estate professionals, my wife and I both felt that the experience with Mr. Zimbro and Touchstone were well below the standard of care for real estate professionals and, based on our experience, we would strongly discourage anyone from doing business with Kyle Zimbro, his agency in Phelan, or with Mr. Lamoreaux and Touchstone in Victorville.
