I am a party who scheduled a mediation appointment with Joan Miller for 9am. Joan requested just days later to schedule the time for 10am instead of the originally scheduled 9am appointment. I notified my employer and made the appropriate adjustments in my pto request. I am employed as part of a team who assists those who are in crisis, and my teammates were flexible with my request. When I arrived at Joan Miller's office in Shakopee I was informed by the receptionist Lisa that Joan was at a courthouse some 20 minutes away and was aware that Joan had just walked into the courtroom. I waited in the parking lot for over an hour and Lisa then called me when Joan finally arrived for our appointment. It was well past 11am by now. I had to notify my employer/team of the situation. If this wasn't already frustrating enough, my experience within the mediation experience was dreadful. I am a Masters level professional who is aware of what the mediation process should and could look like. Mediation, as used in law, is a form of alternative dispute resolution (ADR), a way of resolving disputes between two or more parties with concrete effects. Typically, a third party, the mediator, assists the parties to negotiate a settlement. Three previous experiences with the mediation process, and three other mediators/attorneys all demonstrated and offered the services that were both professional and respectful of both parties involved in the mediation process. Joan Miller did NOT, from the start of our experience to the end of our experience, respect or honor the mediation process as it is designed to serve both parties involved. My experience with Joan Miller was one that received criticism, scolding, sarcastic laughter, and broken-record statements that sounded like she was reading out of a mediation manual. This surprised me given Joan Miller's age and my assumption of her "more experienced" status. At one time during this experience I requested, "Joan, may I ask,..why are you laughing at me?" She went into 'broken-record' mode and never answered my question. Her legal/bedside manners, if you will, were disturbing and puzzling to say the least. The situation at hand was one of great concern and sensitivity regarding a young child's best interest. Joan made comments that ridiculed, degraded and downright shocked me! Joan lacked leadership and failed to guide the mediation process into a productive direction. I shook my head in disbelief and couldn't believe what I was witnessing. Joan's lack of respect with regard to scheduling, the mediation process itself and Joan's outright disrespectful comments raising her voice are a few reasons why I would NOT recommend Joan Miller Law for ANY type of service. After two plus hours of Joan's failure to mediate Joan stated that there was nothing more she could do and requested payment from both parties. As I exited Joan Miller's Shakopee location I contacted my employer/team and apologized for missing the entire shift/day as a result of this experience. I did not know of Joan Miller Law before this appointment and would energetically encourage anybody looking for legal counsel and/or mediation services to look anywhere else OTHER than Joan Miller Law.
