I'd recommend caution if you are thinking of having a trust at JHTC.
Overwhelming evidence from their own counsel as well as trust officer shows they asked me to lie to the IRS and that lie, in itself , had I done it is a criminal felony of fraud, had I done it and then asked for a mortgage or credit anywhere, that would have been another felony as I'd have lied about my income to inflate or.
Until now Ive been merciful and not given their name to the IRS when discussing if this is allowed or if it's a crime, nor have I mentioned in my reviews that they asked me to commit a criminal felony but as they've still failed over a month after resigning to appoint a new trustee leaving me with no trustee to ask for HEMS or the mandatory distribution they have to give me in August, essentially holding my trust hostage with no trustee or contact.
The prior reviews I've left are as follows, giving grace without mentioning their asking me to commit a felony and for me to fraudulently report that I'd received income I never did, it's also a crime for them to report I'd received income I never did (once I pointed out to them they made a mistake it would have been a criminal felony of fraud had they not amended the trust return to reflect the truth.
They made mistakes over the years like writing me check to the wrong person or asking me to liquidate money after 4pm EST when they needed it the following day forcing me to wire them my own money which they later repaid me from the trust. ..mistakes like that.
I loved my 1st trust officer Amy B, she was kind humble & gracious
I continued forgiving mistakes even when their CPA made a mistake reporting I received income from my trust, which I didn't
Not a big deal right? You'd think once I pointed out their mistake they'd just fix it right? Well, no it's not a big deal for people with a moral compass, For Jackson Hole it became a fiasco
Allow me to explain what they did & why I urge caution with them
(My trust officer Amy was no longer there, another person Kathleen Cook took her place)
Instead of just fixing their mistake Katie asked me to report i received income from the trust on my personal taxes (lie to the IRS) going so far to try to clears me by saying if we do it ( which they're legally bound to do) you'll have to pay taxes penalties & fines from the trust I think to insinuate I'm somehow better off paying an accountant to change my return, lie to the IRS & pay them from my own personal money (proof in below photos)
Incredibly, after I told them I won't lie to the IRS which is a felony crime, & they did concede to fix it ( see below proof), these champions of truth then took the money to pay the penalties & interest their mistake caused from my trust! The lack of ethics is baffling.
It gets worse. Had I done what they wanted me to the IRS would have reported to the NY State of health that I lied about my income and I'd be liable to not only pay additional $5-6,000 & face fines including possible jail time for not disclosing this so called income they wanted me to say I got but which I never actually received.
Annnnnddd...It gets even worse.
Despite unequivocal evidence this happened, and that this is a criminal felony of intentional fraud had I done it, the owner Aaron Sones texted me quote " I was very disappointed in our phone call in that you told me my staff told you to lie to the IRS, which is clearly untrue" & I am no longer going to be responding to any texts from you"
After giving them grace and didn't make a big deal that they did that to me & caused my trust to lose money , I have my own money & the trust doesn't have that much in it so I took the hit but what kind of trust company cannot take accountability for what should have been a simple mistake, and I personally wonder if there can be a bigger breach of fiduciary duty (other than to ask a client to lie on a tax return) than the head of the company blocking their client because their client wouldn't lie to the government & had the audacity to say the truth out loud?
So, they asked me to lie to the government, to commit a crime, to use my personal money to support the trust, & the penalties & interest their mistake caused. After conceding to fix their mistake which they should have done as soon as I pointed it out to them then they actually failed to reimburse my trust for the penalties incurred because of their mistake. Then my main point of contact blocked me.
Does it get more depraved than this? I've just now decided to give up thinking they'll apologize or correct their mistake or return my trust to a responsible fidicuary or myself, and pursue the appropriate avenues to alerting people to what has happened read more
