    I hired Kurt A. Russell / Platt Cole Russell & Simpson for my Brevard County bicycle arrest case…read more My experience was extremely disappointing. In my opinion, Kurt A. Russell relies heavily on "his experience" to decide how your case should be handled. But every case is different and requires its own defense strategy. In my case, it felt like he simply decided the best outcome was a plea deal. I did not agree. Worse, they did not properly inform me before that happened. My biggest issue is that a nolo contendere plea was entered in my case while I was not present and without my informed authorization. My presence was waived, my not-guilty plea was withdrawn, and I later had to protest to the Judges office before the plea/judgment was vacated. While speaking to them I also felt the lawyers treated my bicycle case as if it were a driving case. When I challenged the stop and the demand for identification, they kept pointing to case law involving drivers and motor vehicles, even though I was on a bicycle. I specifically questioned whether the law they were relying on involved a car or a bicycle, because a driver's-license requirement is not the same thing as a bicycle stop. In my opinion, they did not want to properly challenge the legality of the stop, the arrest, or the way the prosecution changed the theory of the case. Instead, I felt pushed toward a plea. In my opinion, these lawyers seemed to act more like mediators than defense lawyers. It felt like they were trying to find a "balanced" outcome that made the court, the prosecution, and themselves comfortable, instead of fighting for the client's position. That kind of balance may be beneficial to the lawyers, but it was not beneficial to me as the client. This review is based on my personal experience and the court record. A plea decision belongs to the client. In my case, I do not believe that right was protected.
