A large chain store installed material improperly causing about 3000$ worth of property damage. They won't return my calls, all calls are taken by a receptionist who says my lawyer is 'unavailable'. I get an excuse every time; owner's wife is sick, lawyer on vacation, not available, not in town, not here, I have received 0 updates on how my case is progressing. I have practically begged them for some information. They didn't have to take this case, but they agreed and took my case, asking for cash up front. It has been almost a year since my initial and only consultation. This is criminal, and inexcusable. Now i am faced with not only my original case being unresolved but, taking them to court also. Union College et al, Schenectady NY and the City of Schenectady for their malicious and criminal treatment of me, a Union college freshman. In addition, Mr. Grasso was provided with an enormous amount of documented evidence to support my case of being totally innocent. He stated with bravado that I had a solid case that he could handle. * Mr. Grasso failed to know the law that there is no cognizable cause of action in the state of New York for negligent prosecution or investigation. * Mr. Grasso failed to follow the instructions of the court regarding stating causes of action pursuant to CPLR 3211 (a), (7). * He wrote the complaints to protect Union College and the Schenectady Police detectives. * He took depositions to protect the many illegal mistakes made by the two Schenectady detectives including denying my request for a lawyer and lying 16 documented times in court under oath. * Mr. Grasso failed to use the enormous amount of documentation I had given to him and completely misrepresented my case to the courts to my detriment. * Nicholas J. Grasso deliberately failed to establish the truth that the defendant's conduct, Union College, was so outrageous in character, so extreme in degree as to go beyond all bounds of decency... * Nicholas J. Grasso deliberately failed to establish to the court that Union College's atrocious and intolerable conduct unreasonably endangered my physical safety and caused me to fear for my life. * Mr. Grasso failed to establish to the court Union College Administration's capricious and arbitrary actions toward me. * Nicholas J. Grasso deliberately failed to identify any internal rule or regulation breached by Union College in spite of having in his possession 12 documented breaches of contract according to the Union College Student Handbook. * Mr. Grasso refused to follow Judge Reilly's very specific directives and my instructions for writing a successful breach of contract complaint. * Mr. Grasso failed to submit a breach of contract complaint to the court by the deadline of August 2, 2012. * Mr. Grasso failed to get his client's consent to negotiate a settlement with the City of Schenectady and Union College. * Mr. Grasso failed to inform me in writing the amount of settlement being offered by the City of Schenectady as I had requested. * Mr. Grasso failed to inform me in writing the amount of settlement being offered by Union College as I requested. * Mr. Grasso came to court unprepared: * Nicholas J. Grasso failed to attach amended complaint to his cross motion papers. Schenectady Supreme Court Judge, the Hon. Vincent Reilly chastised Mr. Grasso for coming to his court empty handed. * Nicholas J. Grasso failed to provide any indication as to how any proposed amendment action would remedy the deficiency in his pleading. * Nicholas J. Grasso failed to make any evidentiary showing to support a second amended complaint, therefore a second amended complaint was denied. * Failure to understand and/or read a document, which affects his client's legal rights. * As recently as May and June of 2013, Mr. Grasso completely ignored my 2 requests sent to him by registered mail for the return of certain documents, for a detailed accounting of the $25,000 retainer fee in writing, and also an accounting in writing of the settlement with Union College and the City of Schenectady. I have no idea if they settled or not. I have documentation that supports each and every one of these statements.
