Review of area Estacada business Clackamas River Towing:
If your response regarding a recent Google business review says anything about your character and how this business is ran, one could imagine why my friend and I are pursuing our complaints in a more formal way. Your response on the review, "Complaining on google won't solve anything" (in all caps), was hostile and provoking. This does not represent well in our community nor does it provide any viable lead to any type of solution.
We all need to blast your illegal activities on many review forums for the community to see and look out for. Our attempts at working on a solution with you was followed by even more hostility and bullying.
Our Google review:
Tragically, my good friend was basically put out in the street after her significant other died from a very painful pancreatic cancer 6 months ago. She is my elder and is disabled. Regrettably, she allowed a so-called friend borrow her car back in January. When said 'friend' didn't return, she filed a police report.
'Just a few days ago', my good friend heard that her 2016 Nissan car (that she continues to make $350 /monthly payments on) was found and impounded. When she finally got through to someone, she was told she had to pay $700 because her car was "illegally parked" in Estacada. MINIMUM $700!!!! No exceptions!!
Her car was not illegally parked! Her car (with current tags) was in a PUBLIC parking spot across from the Mason Jar and in front of an empty business front. My friend also lives above this empty business.
The Tow company said It was reported by DeeDee at the Mason Jar as 'Abandoned'? And Amy Kirk (from the tow yard) said, "The parking spaces out front are PRIVATE property". Since when? Where are the signs depicting 'private'? Hmmm....And what's a tow yards definition of vehicle abandonment? This is what the Oregon law says:
https://www.oregonlegislature.gov/bills_laws/ors/ors098.html Chapter 98 -- Lost, Unclaimed or Abandoned Property; Vehicle Towing.
By definition, this was NOT an abandoned vehicle as they would like you to hear. The evidence will speak for itself as we begin the complaint process.
Mahatma Gandhi has said in the same context:
"..its difficult but not impossible to conduct strictly honest business.."
Yeah, we all know that this tow yard WANTS her newer vehicle. Who takes advantage of our vulnerable like that and can STILL sleep at night? We all had hopes for these new 'owners' to serve their community in an utmost PROFESSIONAL and LEGAL manner to ALL consumers.
I understand that people need to make a living and that's how business works. Totally, I get that. We are business owners too.
I called the tow yard Friday for my friend and the first thing owner Amy Kirk rudely stated, "So? She can have it when it's paid for". Then, I asked if they can cut her even a little break; some sort of a break or, even-how about an ear? I mean, this is by no fault of her own and it was not abandoned by Oregon rules.
Again, an emphatic and rude, NO!
Regardless of my friends initial circumstance, the car was still illegally towed.
Bottom line, It's Illegal to scam (conduct) business this way according to the applicable ORS's rules. Part of these rules include FTC consumer complaint processes. The FTC protects consumers like us by investigating and stopping this kind of deceptive practice such as this illegal tow. Therefore, as a remedy of sorts, An FTC complaint with the state Attorney General will be filed regarding the business practices of not following the law. Other options are pending.
I can only imagine how my friend felt being talked to like that. I even called back and asked them to stew it over, perhaps mull over the weekend. "Can you, at least though, give her a few minutes of your time? Maybe even a payment plan so she can at least drive to her doctors in Sandy instead of taking 5 long hours for one 20 minute drive?" (Still can't get over that $700 minimum amount!?!? For a 2, YES, TWO mile drive!!??C'mon!!)
Their answer was a curt, "Nope. Final answer."
For all of us, the rewards of finding an amicable solution, SOONER THAN LATER, to this problem will far outweigh the consequences of rudely maintaining unreasonable positions just to "save a little face".
Please, don't be that 'Least Common Denominator'; don't let this be an ongoing 'norm' of how we treat people and our community.
