On January 6th, 2023, my wife (Julie O'Leary, Daughter, and three grandchildren) were parked at a Target in Overland Park, KS. The policyholder (Brian Nagel) backed into my parked, unpowered 2021 Jeep Grand Cherokee. Mr. Nagle claimed 100% responsibility, and was courteous and kind. He made sure that my newborn granddaughter, two grandsons, and daughter were fine. He also volunteered his insurance information (Auto Insurers Insurance. We immediately contacted the insurance company and spoke with Ms. Janet Demangles-Mckee. I do want to note that our initial conversation was polite, and she started the claim process (Claim Number: 300-0015577-2023. Since filing the initial claim, this company has been completely radio silent with dozens of missed calls and even more non-returned voicemails. It is now March 15th, 13 weeks since the accident, and 13 weeks since we filed our claim. My chief complaints are:
1. My auto is now being held hostage by Reed collision in Overland Park, It is in a dozen or so pieces and cannot be reassembled. They claim that they sent the insurance company photos and a revised claim for hidden damages on Friday 3/10. After numerous phone calls, we have been told that Auto Insurers Insurance does not have any documents. The parts needed to repair my 2021 Jeep Grand Cherokee will be ordered once the claim is re-approved. The parts are most likely going to be on backorder for several weeks, possibly months.
2. Per Kansas law, we are supposed to be provided with a rental car like the auto being repaired. While we are patient and usually understanding, the sub-compact car provided smells of cigarette smoke, will not hold three car seats and does fit that criterion.
3. We have been told by Enterprise Car Rentals that there is a 10-day maximum time we can use this rental.
In short, I would like to file a formal complaint. The driver of the auto has also agreed that this is ridiculous and has agreed to provide any assistance he can. I would also like to request a list of attorneys that can provide legal counsel in this matter.
