70 west is a horrible company that left my wife and I without a home. We went under contract on one of their homes in Peletier. We were closing on the sale of our previous home and purchase of their home on the same day, March 13th. A few weeks or so prior to our closing, we decided to schedule a house showing with our agent to check on the progress. We noticed there were numerous spots of LVP where the floor dipped and made crackling noises when stepped on. We thought the dips might be due to improper leveling of the sub-surface, so we had our agent reach out to 70 West's agent, Andrew Marchetti, who said he would bring it to the builders attention. We were hoping to have them address this prior to moving any further along with installing the floors. Fast forward another week or so, we schedule another showing to check on progress. To our surprise, the majority of the living room ceiling had been ripped out. Needless to say we were concerned and were wondering why no one had reached out to us. We had our agent reach out to their agent again who stated it was a "minor" plumbing leak. Not sure how a minor leak would constitute ripping out such a large amount of drywall and insulation, but I digress. Our agent also asked about the floors again and we didn't hear back on this. We decided to not panic and trust that 70 West was resolving the issue. After all, it is a newly built home, what could go wrong? Well it comes time for our final walk through which was scheduled on Thursday 03/07/24, and our closing was the upcoming Wednesday 03/13/24. We were greeted by the Seller's agent, Andrew Marchetti, and the project superintendent, Kurt. When we go to enter the home, we immediately notice tape plastered everywhere indicating cosmetic issues. We were informed that Kurt had already gone through the day prior and marked these issues which was appreciated. During the time span of this walkthrough, my wife and I marked maybe around 8 cosmetic issues in total, if that. However, the floors still had the dips, and we brought a thermal imaging camera to look for any potential residual moisture damage from the leak previously mentioned. We discovered there was still moisture damage in the corner of the living room ceiling. Kurt seemed to be very receptive to everything we requested to be fixed and even signed a punch out list agreeing to fix these issues. The only fix we weren't in agreement on was the LVP. Kurt proposed they would address the LVP dips by drilling small holes in the floor and using a syringe filled with glue to glue those spots down. We were not okay with this method as that would defeat the purpose of a floating floor. The way we left it was that ultimately the floors would be fixed, but how they would be fixed was yet to be determined. We waited and didn't hear anything back until the end of the day after the walkthrough. We were informed that because we were in a dispute with the method of repair for the floors, they were going to terminate the contract. My wife and I were in disbelief as our home was set to sell the same day we were buying this one. We thought on it overnight and requested to walk the floors one more time the next day to see if we could just accept the floors as-is. When our agent asked if this would be possible, their agent stated that regardless of the floors, they would be unilaterally terminating our agreement as they felt we'd be a liability by burying them with warranty claims. We never once mentioned making any kind of warranty claim, and even made it a point to say we just wanted the punch out list items fixed prior to closing. If there weren't legitimate issues with the home, I'm not sure why they'd be concerned about warranty claims. It's also worth noting there are other reviews on yelp where this isn't the first time they've terminated a contract days before closing. Avoid this builder at all costs. read more
