The…read moredifference between the two was like day and night; the first, on Vancouver Island (Ian Izard), was exemplary. Regular communications, monthly accounting's and frequent telephone calls to advise and listen. It was a rather complicated estate and took over four years to settle. But it was handled with transparency and as efficiently as Probate Court allowed. This attorney however was the exact opposite. Although it was s very straightforward will with little complexity, there was no communication except when forced, no transparency whatsoever and no accounting until the very last day. During the three years it lasted it was an uphill battle to get the simplest of tasks completed. The straw that broke the proverbial camel's back however was that he completely misrepresented explicit directions of the testator, even though he had drafted the will himself. It was common knowledge amongst the family and the alternative executor what was intended, but the lack of explicit verbiage cost the family over $45,000 and much consternation. Plus he should have excused himself from the proceedings due to the conflict of interest, but had to be threatened with being brought before the Legal Board Tribunal before finally recusing himself. Be forewarned, there are much better estate attorneys than this one.

The consultation felt dismissive, impatient, lacking in practical advice, and he provided incorrect legal information that could have caused me to lose my claim. The issue I had was related to a diagnosed condition, which he referred to as "ahaha I don't even know if that's a valid condition but sure, let's say if it is-" Then he gave me incorrect legal advice about Human Rights Tribunal filing deadlines that would have resulted in me filing prematurely with incomplete facts. I asked straightforward questions about strategy, including whether a lawyer letter was worthwhile, whether a human rights complaint should be filed first, and what kind of settlement range might be realistic. I left the call with almost no useful direction other than a mocking tone and a disrespectful attitude from Chris. Chris clarified that this is the universal attitude he gives all his clients, which was a very refreshing thing to hear. Update: After filing a formal complaint about Chris Forguson's conduct with Access Pro Bono, they demand I remove the review. I declined, as the review is factually accurate and serves to inform future clients.

The changes to the regulations of wills, representation agreements, and bequests mean that you should seek out a specialist to help you navigate this complex legal field. They even included the registration of the wills ( strongly recommended by our son, the labour lawyer...who told us to use a specialist firm). Meetings were done online, with reviews via pdf. She took the time to explain the process and all the BC requirements and idiosyncrasies (SO different than the laws governing such documents in Washington state, where I moved here from. Our US documents didn't translate to BC laws, necessitating the drafting up of new paperwork). Anyhow, Kristen was super patient with me, explaining everything to me, often repeating details (a few times!), and helping refer us to other resources we inquired about. I can't stress how much peace of mind it provides, especially as a parent, to have these documents done - and done correctly. Kristen responded to my emails and calls promptly, and I liked how they offer free notarization to their clients (note: other firms we used all charge for notarizing documents). There is free two-hour parking on 12th, and limited meter parking on Lonsdale. (I never had a problem getting a spot on 12th). Top-notch firm.
