Going through the probate process took a long time(2 and a half years) partial due to the nature of the courts and partially due to some more uncommon issues that came up. Including an existence of a trust, but being unable to locate a copy including finding the attorney who originally set up the trust and asking if they had any copies. Unfortunately, the trust was set up before computer records were common. Another problem they helped me with was SunRun decided, for reasons we were never able to figure out, to try to shut of service even after I had began the process of transferring everything into my name and was only then waiting on the deed for the house that I wouldn't have until probate was over. Getting a letter saying SunRun was going to deactivate my service for being overdue on payments while in the same letter saying I owed no money and was 0 days past due was confusing and was confusingto every SunRunemployeei spoke to and none could give me answers. Burris Law helped me tremendously with this and without their help I don't know what would have happened in the end. I can't say enough nice things about them. They sent me 2 small care packages during the process and it was really nice to get something positive in the mail during a time when I was getting anxiety every time the mail came. I'm 69 years-old and disabled from an injury. McKennon Law (ML) represented me in an ERISA LTD…read morecase. I read many reviews prior to hiring them, and they all seemed to be positive. Hmmm. After my case concluded, I told Mr. McKennon that I would leave an honest review, and he threatened me with legal action. Following is my honest assessment of my experience with ML, backed by documentation: The attorneys who worked on my case (Joe Hoff and Zlatina Meier), were knowledgeable, competent, and thorough, as well as friendly and professional. We had an excellent rapport throughout two plus years of litigation. I had been clear from the beginning that I couldn't sign non-disclosure or non-disparagement agreements as part of any settlement, because I needed to be able to discuss the outcome of my claim freely in other pending actions. During the mediation, Mr. McKennon became angry about this and raised his voice in a way that I believe was threatening and unprofessional. There were several issues in my case, and the ins co owed me as much as $300,000 in unpaid benefits, PLUS the accrued interest. The Judge decided in our favor on only one of the issues, and awarded just $31,016.65-- $17,534.10 in unpaid benefits, and $13,482.55 in interest. There was one issue where I thought ML had omitted an important argument, and another that I think would have been decided in my favor if their argument had been communicated more adamantly, but at that point, I still would have given them a 4 or 5 star review. My assessment quickly changed when I saw the final accounting! ML sent me a breakdown of the fees they were going to deduct from the proceeds. I was speechless! It was not what I'd agreed to in the fee negotiations, and not what I believed I'd agreed to in the Representation Agreement! My understanding was that I would pay ML 30% of the proceeds and reimburse their expenses, and they would keep any attorney fees awarded, but they had also subtracted the INTEREST that I had been awarded! This was never mentioned in our fee negotiations! After 16 years, the interest owed in my claim was likely to be more than my unpaid benefits! I would never have intentionally agreed to give them as much as 50% of the proceeds in addition to the 30% contingency fee! The photo attached is a Table created by ML, that breaks down the proceeds. After subtracting their fees from the $31,016.65 awarded, what remained was just $1,312.10! ML was planning to take 95.8% of the award, leaving me with 4.2%! ML denies that they were deliberately deceptive, but I disagree for the following reasons: 1. All prior communications with ML had been via email, but they insisted that we negotiate the fees via telephone-- there is no record of what I'd agreed to! 2. I'm not an attorney, but I have a strong legal background. I read the Retainer Agreement three times before I signed it. I misunderstood one line-- one word, actually-- that gave them the right to keep any interest awarded. The language is unusual-- not normal legal parlance. I believe they hoped I wouldn't catch it, and I didn't. 3. When they sent the Table (see photo) with the breakdown of their fees, directly above it they had pasted the deceptive (in my opinion) line from the Agreement! Just that one line! Clearly they were EXPECTING me to be blindsided when they subtracted the interest! 4. When I informed Mr. McKennon that I was going to file a complaint with the CA Bar Assoc. about the deceptive language and unfair fees, he promptly decided not to subtract the interest! I also believe that the expenses ML charged me were inflated. For example, Ms. Meier said that my share of the mediation fee would be $1,450, but ML charged me $2,675.00. When I brought that to their attention, they refused to adjust it. Total expenses charged were $6,083.40. The 30% is subtracted FIRST, so the client actually pays expenses at 130%, per the Agreement. I reimbursed them $7,908.42, and the Judge awarded $4,778.40 for expenses, so they were reimbursed $12,686.82 for $6,083.40 in expenses, which they KEPT. The Judge also awarded ML $222,570.00 in attorney fees (at $650-$850 per hour). They worked many hours on my case and I'm glad they were paid, but after expenses, ML received a total of $252,281.65, and I received $15,628.26. Contingency fees are high because the attorney risks not being paid, but the fact is, as long as they get you even a small recovery, they are usually awarded attorney fees. Their actual risk is minimal. If you decide to hire McKennon Law to represent you, I suggest that you keep all fee negotiations in writing, and have another attorney look over the Retainer Agreement before you sign it. Be aware that what you actually pay in fees may not be what you thought you'd agreed to!

They were pissed, but weren't willing to do much to correct the leak in a reasonable timeframe (which is still here today, December 29th, 2024).
