    Don't ask Advance Paving for a quote if you don't want to be SUDED…read more As our HOA road committee chairman I contacted Brett Johnson, owner of Advance Paving requesting a quote for road repairs. Mr. Johnson did come and reviewed our roads and pointed out several improvements that needed to be considered. He also assured me he knew the guidelines HOA's had to operate under. Being an HOA, you must have at least 3 quotes on expenditures over $50,000.00. After Mr. Johnson was told that the Board picked another company that was over $9.00 per square foot cheaper than his quote. Upon learning this he filed a $20,000.00 lawsuit in small claims court for breach of contract. There was never a contract offered, written or signed. No one ever told him that his company would be chosen by the Board. Mr. Johnson never asked if his company had the job. The case was heard by Judge James Meredith, JP for precinct 3 on November 14, 2022. After Mr. Johnson gave his testimony our attorney requested Judge Meredith to dismiss the case against the HOA. Judge Meredith did so. Advance Paving was ordered to pay the $900.00 legal fees the HOA incurred in defending itself in this frivolous lawsuit. Anyone that deals with Advance Paving needs to beware of the type of company it is.

I was led to believe through multiple…read moreconversations that the paid price included a final top layer of asphalt millings once home construction was complete. My wife had a similar in-person conversations with him, stressing that the only reason we had chosen him over competing bids was because he would come back and add the final layer. When construction was complete, Mr. Johnson acted like we had not agreed on this, using a sparsely detailed "Invoice" and also trying to suggest he had paid for stump removals during the initial construction. A man of integrity would admit both parties should have well documented and clear communication, and then take steps to rectify the situation. He did none of these things. I would advise extreme caution in contracting with Advanced Sealcoat and Paving, because it appears as though the business model is to take advantage of smaller jobs and individuals.
