When I sold my rental house in…read more2019 I paid Ms. Prados $275 for a one-hour consultation to calculate the capital gains tax I would owe so I could make the estimated tax payments prior to filing in 2020. We went over the paperwork, she calculated my gain at $216,000 and wrote a note saying, "0 rate on the capital gain ..." I was incredulous since it is well known that sales of business property are taxable. "I haven't lived in that house in over six years," I said. But she did not respond. This is one my complaints. The woman was very uncommunicative overall and would not answer a number of my questions such as why I did not owe a tax. However, she asked what I expected my income to be during 2019 and I estimated under $35,000. She photocopied a page from a Master Tax Guide and underlined a section that stated that the cap gains tax rate was zero if taxable income is "less than $38,600 if single ..." I repeated that I couldn't believe I didn't owe any tax but said, "you're the CPA, I'm sure you know what you're doing." When it came time to file my taxes this year, I tried to do it with Turbotax, which calculated I owed $21,000 cap gains tax on the sale. I became very upset at the prospect that I might be hit with a $2,000 penalty for not making the estimated tax payments. Not trusting Turbo, and having conflicting advice from a CPA (who had been recommended by a prominent Miami Shores financial advisor), I called Ms. Prados. Both her assistants stonewalled me repeatedly and would not let me talk to her. I was a client and she wouldn't even take a two minute phone call. So I sent Ms. Prados a letter explaining the situation and asking what I should do. She never responded and when I called to follow up I was again stonewalled and told I had to pay for another consultation. I agreed, expecting her to do my 2019 taxes. I sent her my documentation and she called me saying several documents did not scan well. I resent them in different format and she indicated she would review them over the weekend. I never heard from her again, despite numerous emails and phone calls. Very unprofessional. Very disrespectful. I ended up having Jackson Hewitt file my taxes. Both the tax preparers (one who said she has been doing taxes for 20 years) confirmed that I owed $17,000 capital gains tax. They also said that one does not have to make estimated tax payments on capital gains. Before you retain Ms. Prados consider this. How could anyone, let alone a CPA, "miss" the fact that this was a rental house (not owner occupied in which case the capital gain would be excluded, despite the fact that it was the premise of the whole consultation and I repeated the fact several times during our meeting. The error was so obvious, so grossly incompetent, I have to wonder if it was deliberate and malicious.
