I reached out to this lawyer as I had received a DRAFT of a will that he completed for my mother and father (at my brothers request). I asked him how it was possible to do a NEW will for a person (my dad) that is suffering from late stages Alzheimer's (who wouldn't be deemed competent enough to understand the will). Additionally, I shared concerns that my brother (who engaged him) was being listed as sole POA and Executor on wills that really shouldn't be redrawn as both my parents have active wills from 2005 (prior to my Dads Alzheimer's).
He kept asking me my concerns with the new will for my father - I told him clearly my issue is my brothers requesting it, and that he (the lawyer) is doing it and charging for it (when my father will be unable to understand and then sign it) The $$ for this is being paid by my mother (via my brother who seems to have control of her accounts).while my fathers not legally capable of signing the will. This seemed highly unethical that he would even prepare this draft will. In my conversation with Mr. Tatham , when he didn't like me questioning him about the ethics of redoing a will for someone that is entering late stages Alzheimer MR. Tatham responded by saying 'I question your competence'. I was stunned,
Unbelievable.
It got worse when I talked to my mother - she identified that she was unaware that a will was being drawn up for my father by Mr.Tatham and that she hadn't even seen the drafts yet !
I will be sending a complaint to the Upper Canada Law Society around Mr.Tathams ethics (or lack thereof).
