My family and I purchased lots at Sunset Memory Gardens following the passing of my father in 2005. There were only two lots adjacent to my parents' so my brother purchased them. I purchased four lots and requested they be directly across the road from my family's plots. That section of the cemetery was undeveloped at that time; however, I was assured it would be developed next and it would not be a problem for me to have my requested plots. I waited several years and still had not received any deeds. When I inquired, the sales agent contacted the owner of the cemetery who lives in/near Chester, SC and he assured her it would be no problem for me to have the four lots directly across from my parents and, should the need arise for them to be used prior to that section being developed and the deeds issued, he would make it happen. I relied on that representation. This week, I am in need of one of my plots to bury a loved one. When I went to the office to inquire, I was told it would not be possible for me to have the lots I purchased in 2005 and that I would have to choose lots in an unrelated section of the cemetery. I cried. When the sales agent pulled my file, she read her own note (made in 2007 or 2008). She then said it should not be any problem for the owner to honor his word but she would have to contact him and then call me back. When she called me the following afternoon, she said he would not honor his word because he and his partners were not spending any money on the cemetery at this time and that included surveying out my lots and issuing my deeds to the same. (The sales agent had already told me and my husband that doing that would take only 24 hours.) Since I paid for the lots and waited 11 years, I believe I am not being unreasonable to expect to be able to bury my family members across from where my father is interred. How is this a good business practice? How is this honest? I paid my money in good faith and I trusted the representations made to me.
