Captain Ken Ariola, with the Montgomery County sheriff's office, said deputies first responded to the Sterling Ridge Village subdivision of Archwyck after residents reported hearing shots around 11 p.m. Monday. However, the scene quickly grew to include multiple law enforcement agencies firefighters and medics. John Webb, 55, of Conroe; Justin Webb, 29, of Denver City, and 58-year-old David Vance, of Magnolia, were each charged with deadly conduct, a third-degree felony punishable by two to 10 years in prison and a fine of up to $10,000.
According to Ariola, deputies were en route to speak with a resident on South Archwyck Circle who reported shots fired when another resident on the street reported their home was struck by gunfire. Responding deputies heard additional gunfire after their arrival, he said. " We didn't know if we had a sniper or what, at first," Ariola said. "Fortunately, although it was very close, no one was hit. "
The Montgomery County S.W.A.T. team responded and it was assisted by the Precinct 3 Constable's office, Houston Police Department Fox Unit helicopter and by an HPD. K-9 unit on the ground, as well as additional Montgomery County deputies. "They continued firing shots after the helicopter was overhead, " Ariola said. " You can't miss a Fox helicopter with a beam shining all over the place. "
The S.W.A.T. team located and arrested the three men, who were allegedly shooting at targets with .308 deer rifles in a 35-acre property beside the Archwyck subdivision, he said. "There was no indication that drugs or alcohol were involved," Ariola said. However, blood tests were taken after the suspects were arrested between 4 and 5 a.m., he said.
