I'd love to be able to give this firm a 5-star review, but truth is they do not deserve it. At first I felt relief. I felt like it was worth the super-long drive from the OC, but really I wish I had chosen a firm closer to home. These "attorneys" are NOT highly responsive. TODAY I received a letter from the court that I had discussed with my assigned attorney 8 days ago. I don't think it's an oversight. I'm not sure what's going on, but I got the papers requested to the attorney THAT SAME DAY via email. Now this?! I'm waiting to see what happens. Today is a Saturday, so nothing I can do or anyone else. This issue was supposed to be handled already. Or at least that is what I was led to believe. I hate feeling powerless. But as a homeowner who hired this firm to handle my loan modification issues for me... and their solution was filing a BK 13, which did solve the issue for a time... I am powerless. I cannot go to court to respond to the document I received 10 days ago (that I fully discussed with the attorney 8 days ago) and again today with a cover letter from my attorney of all things. I can't go to court because I am represented by the firm. So I am not happy. I'm sure I'll get some sort of response here about my unhappy review, but truly if a firm gets so large that they no longer care to hold up to their word, well, I guess it's time to stop getting glowing reviews. I hired Resnik, Hayes and Moradi in 2017. First of all they were hired to arrange a meeting with the bank and that would give me a better idea. Never did. Resnik, Moradi are worst attorneys, they are both thieves. Do not hire them. Even after you close it, they follow you to steal even more. Unfortunately judges approve it. They worked for $4,000 to $6,000. I paid them $15,000 for couple of month, with no result. They have filed for 6 months of work in Bankruptcy, $26, 713. I just started working with Matt Resnik and I'm happy with what's happened so far. I'm writing this at the beginning of the process so I am tempering my enthusiam with a 4-star review. I got churned out of the HAMP machine after 6 years. In 2014, I'd handed the mess over to a lawyer who managed to delay foreclosure for over a year, but not get the loan modified. The loan servicer would not verify all my income, despite the proof of income we submitted. In the end, the loan servicer (RCS) pulled a fast one. They did verify my full income, but said the arrearages were too high. Well, duh, you stalled this long enough for that to happen. It wasn't a matter of whether I could pay off the arrears or not. There's a cutoff for HAMP applicants; the arrears at the time the application is evaluated can only amount to a certain percent of the loan's balance. Mine, RCS said, exceeded that cutoff. It didn't, though. They had used the balance stated on the monthly bill. They were supposed to use the "capitalized balance," which is the basic balance plus all the arrears. They declined the application because they wouldn't read the instructions, and managed not to tell me or my lawyer for two weeks. They didn't send out a letter, so I never saw the crucial offer of 30 day in which to file an appeal. My lawyer should have informed me, but he refunded 1/3 of his fee and skulked away in defeat. He said RCS was the worst firm he'd ever dealt with. Now there was a sale date. I was not going to let a property I'd invested small fortune to buy and repair in be auctioned off "behind the courthouse steps" to parasitic zombies. I sent a letter to RCS's escalation address, informing them that they did the calculation wrong and wrongly denied a loan mod. With a few days left I found Matt Resnik via Nolo.com, and I am grateful not to have been laughed out of his office. His staff and I had to exchange data and documents very quickly on Friday and it all got done. There's still a battle ahead but for once I have an intelligent advocate with an impressive staff. More on HAMP, finally expires this year: HAMP is sick joke. It should be called HAMPER. My loan servicer approved ob=nly 12% of the HAMP applications it received. The US Treasury has that data. I wish I'd had it before I applied. If you are awarded a HAMP modification,The 2% interest rate expires after 5 years, and then you get whatever the 30 yr fixed is at the time the mod was approved. Paying your arrears over time or as a balloon payment is built into it, too, unless an extreme miracle happens. In the process, you might end up facing foreclosure. In that case, notices will be posted on your house and you'll get multiple scary letters every day for weeks at a time. You will ruin your credit in the process, inevitably. HAMP expires at the end of 2016 and I don't think it will be missed. If someone reading this is new to the loan mod racket, get acquainted with NPV calculations, (https://checkmynpv.com/) and the guidelines loan servicers are supposed to adhere to (https://www.hmpadmin.com/portal/programs/hamp.jsp). Look up who owns your loan at https://www.mers-servicerid.org/. Find out if your state has judicial or non-judicial foreclosure. The latter make it easier for homeowners to lose their houses than it is for renters to lose their apartments. Landlords have to win a lawsuit to evict; loan servicers just decide they have the right to foreclose, even if they don't have anything to prove it. read more
