Despite this, his daughter told both of us that Mr. Weinberger interviewed her multiple times, preparing and coaching her to testify against her father -- all without her father's consent or knowledge. This was not only inappropriate but also caused the child severe anxiety and emotional stress, as she was being pressured to take sides in a custody dispute she should have been shielded from. Attorneys have an obligation under the California Rules of Professional Conduct to avoid conduct that harms minors or undermines the integrity of the legal process. Under California law, only the parent with legal custody may authorize a minor's participation in such interviews (Fam. Code § 3025.5). The opposing parent had no legal authority to give that consent. Mr. Weinberger's repeated involvement with the child, in my opinion, violated both the law and ethical duties owed by attorneys. We will be reporting Mr. Weinberger to the California State Bar for investigation under, among others, Rule 4.2 (communication with a represented party without consent) and Rule 8.4 (misconduct involving dishonesty or prejudicial conduct). Based on my personal experience, Mr. Weinberger's actions crossed serious professional and ethical lines, harmed a minor, and undermined fairness. I would strongly caution anyone considering hiring him.
