Late Discovery Regarding Client Dispute
The client demanded a refund after declining to pay for a $2,000 per month service, despite being charged an introductory rate of $500 a month. As outlined clearly in our contract and agreed to in writing on multiple occasions, the introductory rate was conditional on future increases based on results or a pay-per-service model.
We fully upheld our contractual agreement; however, the client did not honor her commitments. We offered to continue providing services at the rate she paid or on a per-service basis, but the client refused. She did not appreciate our clear boundaries and subsequently threatened to damage our business reputation.
To provide full transparency, please refer to the provided photos, which display the campaign results achieved during our engagement. See Google Response- "Dear Burgandy,
I am truly sorry to hear about your dissatisfaction, and I take your feedback seriously. However, it is crucial to clarify certain inaccuracies in your review to ensure a fair understanding of our professional collaboration.
Return on Investment: Our records, publicly shared, demonstrate significant improvements in lead generation and visibility during our engagement. These metrics, crucial for gauging real estate marketing success, reflected positive trends as a result of our strategic efforts. We met weekly to discuss performance, and the results consistently exceeded industry benchmarks. For instance, on March 26, 2024, you mentioned that the improvements were "Sooo much better," highlighting your satisfaction at that time with the progress made.
Professional Conduct: Our interactions were always guided by a commitment to professionalism and transparency. Any strategic suggestions or changes were mutually agreed upon through well-documented communications, which counters the claim of verbal manipulation. Furthermore, on April 10, 2024, you acknowledged the effectiveness of our marketing strategies, noting that a prospective client remarked she "sees my signs all over the place and on social media" leading to a $600k home listing.
Financial Agreements and Refund: The financial terms were clear--payments were made against specific deliverables, with half of the paid amount directly allocated to ad spend, not as compensation to me. Significant work was performed in good faith with an agreement for compensation that resulted in $3K paid by you leading to $60K in commissions. On April 12, 2024, you remarked, "But everything you've done has been amazing and literally changed everything! It's all helping so it will all pay off!!" These statements support the tangible results achieved through our collaboration.
Service Continuation and Strategy Decline: In April, when it became apparent that the financial commitments were unmet, I had to make the difficult decision to decline further service, specifically declining to write a marketing strategy for your new listing which had no activity for two weeks. This decision was based on a clear understanding that our engagement requires mutual commitment to agreed terms, which includes timely and agreed-upon financial compensations.
Account Disconnection: The decision to disconnect your Business Manager was initiated by your admin. This action limited our ability to manage and optimize your campaigns effectively. You disconnected the account on May 8th after requesting additional marketing strategies without corresponding payment.
Given the complexity of this situation, I will not be discussing this matter further without legal representation to ensure that all communications are properly handled.
As a final note, I want to emphasize my commitment to transparency and accountability in all professional relationships. In the interest of providing full clarity and to support the factual nature of our discussions, I am open to providing records of our communication to any interested party. This includes exported texts, direct messages in PDF format, and MP4 recordings of audio messages. These documents will effectively illustrate the nature and professionalism of our interaction throughout our business engagement.
Thank you once again for addressing your concerns, and I hope this clarifies the situation comprehensively.
Best regards,
