The Toney Law Firm

The Toney Law Firm

(4 reviews)

I am going to be as kind and fair as I possibly can. I don't want to write this, but if I don't,…read moresomeone else may suffer the same hardship. It makes me quite sad that I feel this review is necessary. The Toney Law Firm appeared unable to manage my husband's probate while protecting MY assets (large property, 2 homes). My husband died, unexpectedly. My daughter urged me to contract with Mr. Toney's firm (for probate) because "daddy's friend" (also an attorney) recommended them. I was asked to pay upfront fees ($3500) before being allowed to meet Mr. Toney. Certainly, I felt a fellow Gator alumnus would take care of me "in all kinds of weather." Sadly, nothing about my experience represented "compassionate legal services for elders;" it was upsetting and challenging. I would like to add that my daughter was also involved in this probate action. I am paraphrasing all remarks. When we met, I was seriously injured (not my fault), disabled, & in significant pain. Mr. Toney is very charismatic and charming. I liked him. Mr. Toney advised I was entitled to only 1/2 of my property (wedding gift, 1983), appearing confident that his plan was the only lawful way to proceed, and that other attorneys would agree. I was told that nearly 4 decades of marriage didn't matter because there was no Will. I was given a "flow chart" and advised, "This is the law, there's nothing you can do." Mr. Toney said (in front of my credible witness), "Getting another opinion will only waste time & money." I was asked to record all mileage/expenses. Then, things seemed to change; it appeared the firm cared nothing about me. I left feeling hopeless and helpless. I followed Mr. Toney's instructions while researching Fla. statutes related to marital assets. I was in tremendous distress but had no intention of interfering with the courts, of course. I politely emailed the firm to ask if Fla. had statutes allowing Mr. Toney to request faster progress, as I was facing surgeries. The response was most unkind, in all CAPITAL letters. I advised the firm regarding my research of statutes and explained my investment of money and time, over decades, yet I felt disregarded. I recall being "reminded" that expressing concerns & asking questions (to excess) could result in client termination (with loss of funds paid). The courts were blamed for the lack of progress. In desperation, I requested a face-to-face meeting with Mr. Toney, but neither he (nor his associates) were available. The office administrator advised that Mr. Toney was out of the country (another staff member told me he was in the office). I was offered a 15-min. phone meeting 3 wks. from the date of my request. After SEVEN months of tears, anxiety, lost sleep, & emotional pain (I feared I would become homeless), it appeared Mr. Toney's plan was going forward, regardless of my concerns. I consulted with another attorney who explained she could ask the Courts to terminate Mr. Toney's firm from the probate. While still under contract with Mr. Toney, I sold my property. At closing (with credible witness present), I asked "Mr. Toney, are you sure there are no state statutes/legal processes that will allow me to retain more than 1/2 the value of my property?" Scott Toney said "No. You should have come to me before your husband passed away." Soon thereafter, the Courts terminated my contract with the Toney Law Firm. Each new Court Order (submitted by the new attorney) was signed within 24-72 hrs. The courts granted me the TOTAL value of my property. A subsequent Court Order required Mr. Toney to forward my funds to the new attorney. I lost a substantial sum of money to the Toney Law Firm. I paid the new attorney to complete the probate and to develop another set of "end of life" documents, for me (I was advised the documents prepared by the Toney Law Firm contained 3 substantial errors). I would say the worst aspect of this experience is I can no longer trust licensed professionals, even a fellow Gator. This review has been reviewed by 2 legal professionals (familiar with ALL of the pertinent documents) before I decided to post it. I have been assured that my words are accurate and more than fair. I have no doubt that the firm is quite capable of completing a variety of other legal tasks but I cannot recommend the Toney Law Firm to manage a probate.

Unfortunately, our experience was very disappointing. Despite leaving multiple voicemails, no one returned our calls. When we finally reached someone, the person we spoke to was unhelpful and when we had questions he said he'd get answers and call back but never followed up as promised. when we made second attempt to schedule a consultation, the person at the office was dismissive and spoke to us in a very condescending way. We felt disrespected and ultimately went to a different lawfirm

I recently had the pleasure of meeting and working with Adam on some pretty serious legal reasons;…read moreand the process has been virtually painless due to Adam's knowledge, availability, ability to educate his clients on their cases/ reasons they seek his expertise and his incredible professionalism. He's the ideal match of an impressive attorney and a guy who feels like a caring neighbor with southern to boot! He made my legal woes a piece of cake and even, dare I say, enjoyable?! His understanding personality and kindness separates him from the majority of attorneys who are just looking to get their job done and get paid... Adam's priorities are more focused on the client(s)' experience throughout the legal process; and he will go above and beyond to make sure everything is done with the utmost professionalism while maintaining a great relationship with his clients. I will be going back to him for any more legal needs that are in his wheelhouse. I would HIGHLY recommend Adam's services if you are looking for legal help in family and marriage law as well as estate planning. He will help you get everything in order so you have a piece of mind that complicated legal matters (concerning the types of law I mentioned previously) are taken care of- ultimately providing not only great legal services but confidence in regards to your legal matters in estate planning and/or marriage & family law. Do yourself a favor and call Adam Roark... you can thank me later!
