However, early in the…read morerepresentation, it became clear to me that pursuing a trial was not something he was willing to consider. Each time I asked questions about strategy, challenged the State's position, or expressed interest in going to trial, I was told that he would withdraw from my case if I did not accept the State's plea offer. Throughout the case, Brandon frequently mentioned that he is a former state prosecutor and that he was familiar with the lead prosecutor assigned to my matter. I consistently felt pressure to accept the plea and was repeatedly told that the offer was "excellent," with the implication that refusing it would leave me without representation. My criminal history consisted of a single prior case from 2004, more than two decades ago, in which adjudication was withheld. Other matters over the years were dismissed. Based on this, I expected that my defense would at least explore the possibility of a similar outcome. That option was never meaningfully discussed or pursued. During negotiations, the State referenced prior charges, including public intoxication and other matters that were not mine. These claims were not challenged at the time. It was only after I accepted the plea that my record was reviewed in court and it was acknowledged that those alleged charges were not present. I was also told that I could face up to five years in prison if I went to trial. When I later appeared before the judge, the judge stated on the record that the charge carried a maximum penalty of one year. This discrepancy left me feeling that the potential consequences had been overstated, which affected my decision-making. Additionally, I was never provided with a written flat fee agreement and never signed an engagement or fee contract outlining the scope of representation, services to be provided, or whether any portion of the fee was refundable. I paid the fee without receiving written documentation. I later learned that written fee agreements are required so clients clearly understand the terms of representation. After requesting fee arbitration to address this issue, I received a cease-and-desist letter rather than a resolution of the fee dispute. I have since advised that I intend to raise the matter with the appropriate regulatory authority so it can be reviewed independently. Over time, communication became strained and unprofessional where sexual in nature remarks were made. He shared with me that he and his wife were separated and that his wife was taking pills and had a poor choice in men that she dates. There were hostile phone calls, raised voices, and profanity. When I disagreed or asked for clarification, the response was often a threat to withdraw rather than a discussion of options. This man should not be representing anyone in such serious matters as half the time he seems spaced out and eyes always glazed over. Based on my experience, I did not feel that my interests were independently or aggressively represented. I left the process feeling pressured rather than advised. For these reasons, I would not hire Brandon again and would not recommend him to someone seeking a defense attorney who is willing to carefully review the facts, clearly explain fees and representation, and fully prepare for trial.
