Initially, seller wanted 60 days to move from date buy contract was signed. Our offer was accepted, then realtor contacted me to say seller decided he needed 60 days to move, After Closing. I was against, but realtor assured me seller would have to pay RENT after closing. Realtor neglected to put those terms on contract. She only put 60 clause for her seller. Very early on, I sent realtor written notification expectations for rent. It's only fair. We are paying rent & a mortgage, while seller lives in our house, he should pay rent. The realtor made decision NOT to talk to seller, until it was near closing. When it came time to close, seller refused to pay any rent. He said he wasn't paying a dime because his realtor didn't put it in the contract. Keep in mind, a dual realtor is legally obligated to represent buyer and seller without any favoritism, biases or breach of confidence. When seller refused to pay rent, I planned to exercise my right to evict seller after closing for failure to pay rent. Since my realtor was under the obligation to be fair, unbiased and not divulge any confidences to her seller, I asked if she was familiar with any good real estate attorney's. She happily referred me to Skipper Drost. In doing so, she neglected to inform me of a conflict of interest. Drost Law Firm represents realtor's Century 21 Real Estate Lake Charles. I didn't find out this information until much later. I call & talk to Skipper Drost. I told him my story. Not once did he advise me, he represents Century 21. Again,conflict of interest. At the call close , Skipper assured me he could help. He instructed me to have contract emailed, so he could take a look. He said he would get with me on options, we would have. He knew my intentions to evict seller for refusal to pay rent. Never heard from Skipper again. I tried to call him back & he would not return calls. Sent him an email & he ignored. I find out he used our conversation to gain information to be used against me in real estate transaction. It's apparent, he wanted contract to determine how to help Century 21 & realtor out of a jam due to her negligence for not adding rent to contract for 60 days. What happens next is directly related to my interaction & conversation with Skipper regarding seller & realtors. We are ready to close. Suddenly for days, realtors claim they can't get in touch with seller. Closing date is coming up with seller missing . There was an expiration date listed on contract for closing date. My lender continually reminded realtors before & after disappearance of seller...if seller wasn't going to be able to close in time, then an extension was needed by seller. Once closing date expired due to breach by realtors & seller, he is now available on Monday after expiration. It was a planned legal maneuver. My husband is unconscious at the time, after having a liver transplant. I had to act for both of us. Then, I have realtors demanding I sign a new amendment giving seller free rent. Or else, we lose money on appraisal & they wouldn't sell us the house. I was coerced at a time when I was an emotional wreck. My confidence was breached by Skipper Drost to realtors & broker. My private conversations with realtors were shared with seller regarding my right to file for eviction after closing. Both attorney and realtors acted in an unprofessional and unethical manner. We closed on September 29, 2023 & seller hasn't moved out. *The realtors & brokerage have several official complaints pending against them. *Skipper Drost has a pending complaint from me against him for ethics violations with the State Bar of Louisiana. *Google Skipper M. Drost (Fact: several years ago, Skipper M. Drost was disbarred for a 2 year time from for violations.)
