I have never been this unsatisfied with a professional business than my dealing with this firm…read more They do a lot of "Puffing" (All Talk). If they had spent as much time on my case as they spent on one of their TV commercials, we might have gotten someplace. The fact is I had to complain to the office manager even to have them file a law suit. The event happened 06/2017. Nothing was filed until 02/2018, and then it is questionable if the right parties were sued. We will never know because depositions were not taken; The property was never videotaped even after before covid to show how dangerous the parking lot was; Matt Tucker, the attorney, NEVER followed throw anything except for thing to getting me to sign a settlement that would not even cover my true medical bills. He started telling at the beginning of the case that he would not settle for under 65-70k. We settled for less than 1/2 that figure. I was put into meditation with Whitner not making proper discovery. I called the managing partner with my concerns, and he promised that we would go over the file and tell me what I should expect. He said that he would be going along to the meditation. The meeting was done over video at the Whitener Firm, and he did not even come in the room to introduce himself. I learn more about the law and the road my case was going down from the arbitrator the I ever form the attorney that was being paid to deal, with it. The sad part was the arbitrator said, "I am sure your attorney has gone over all of this with you". I was caught so far off guard with the information she presented me with that I did not know what to do. I am an accountant, and you can't read me very well, and Matt had no clue that I was pissed. If my attorney had done half of what he said he would actually do, we would have gotten someplace. He could have done a lot without it costing anything? (Fire Department had been out at that location a dozen times over a 19 month period. I know that because I did the research. Did they ask for the 911 tapes? NO). Just those tapes would have to a story. Two depositions and the questions did not get answered and, in fact, the wrong individuals were deposed. My attorney said, "Don't worry, we will file a motion in court to deposed them or whoever the correct person again, and they will have to pay for it" Puffing, It never happened. I called this firm twice asking to be assigned a different attorney, and twice I was denied my request. One was to the managing partner. What did he do for me Nothing but PUFFING PUFFING! Just the highlights of her terrible…read morerepresentation of me and my kids' interests: She did not disclose to me her personal friendship with the opposing counsel, Meredith Johnstone, and actually made it seem like she didn't like Johnstone. In my opinion, this conflict of interest created an ethical problem in several situations. For example, I paid her for her time toward creating a parenting plan that I had already agreed on with my ex; she did not create the parenting plan but instead got money for her personal friend by pressuring me into having my ex pay Meredith Johnstone to write the initial parenting plan. In over 7 months she was unable to finalize a parenting plan that was completed in about 2 weeks once I switched lawyers! (and btw, she charged me several hundred dollars to prepare my file when I finally got brave enough to switch lawyers). Kym missed a deadline and sent me documents right before they were due, despite agreeing to complete them right away after we met; since I work nights I didn't even have time to review the documents before having to submit them to court. More than once she took weeks to respond despite my multiple attempts to contact her. I feel like this combination of lawyers created problems that weren't previously there. Kym's communication skills were terrible in my experience; not only was she bad about reasonably prompt responses and meeting deadlines, I gave her documents and told her my priorities for the parenting plan multiple times and it seemed like she never advocated for those priorities to enter the parenting plan - also seems a little convenient that the more disagreement between my ex and I and the more times I have to explain my position=more money for these two lawyers. She charged me for multiple calls between herself and Meredith Johnstone that did not equate to a parenting plan reflecting my interests even after I asked her to stop billing me regarding the topic of scheduling because she was so ineffective in that regard. There are lots of lawyers in New Mexico, please don't be swindled by this one like I was! Kym sat on the New Mexico State Bar Disciplinary Board and is probably friends with most of the current members, so I don't expect anything to come of it, but I filed an ethics complaint against her.
