Re: URGENT: Elevator Non-Compliance, Expired Inspection, and Violation of Tenant Rights at 130 Pelham Rd. New Rochelle NY 10805
To Samson Management,
I am writing to formally document a severe maintenance failure and safety violation at 130 Pelham Rd, New Rochelle, NY. The building's elevators are currently out of service, a condition that constitutes a breach of the warranty of habitability and poses a direct threat to the safety and welfare of all residents, particularly those with disabilities.
1. Violation of Inspection Mandates
I have observed that the inspection certificate currently displayed in the elevator indicates the last inspection was performed in 2024. Under New York State Property Maintenance Code and applicable safety regulations, elevators are subject to strict annual inspection cycles (Category 1 Annual Safety Inspection). The absence of a current 2025/2026 inspection certificate suggests a failure to maintain compliance with ASME A17.1 Safety Code for Elevators and Escalators.
2. Negligence Regarding Residents with Disabilities
The failure to maintain operational elevators is not merely an inconvenience; it is a violation of the Fair Housing Act (FHA) and the New York State Human Rights Law. By failing to provide functional vertical transportation, you are effectively denying reasonable accommodation to tenants with mobility impairments and disabilities. This negligence creates a discriminatory barrier to entry and egress, trapping vulnerable residents in their homes or forcing them to attempt unsafe stair navigation.
3. Demand for Immediate Action
The current situation is unacceptable and exposes Samson Management to significant liability. I am requesting the following actions be taken immediately:
* Immediate Restoration of Service: Expedite emergency repairs to restore full elevator functionality.
* Proof of Compliance: Provide proof of a valid, current inspection or a timeline for when the overdue inspection will be rectified.
* Communication: Issue a building-wide notice explaining the cause of the outage and the expected resolution time.
Failure to rectify this situation immediately will force us to escalate this matter to the New York State Division of Homes and Community Renewal (DHCR), the New Rochelle Building Department, and legal counsel to pursue rent abatement and damages for the reduction of services.
I expect a written response regarding this matter within 24 hours.
Sincerely,
Ramos
