First off DO NOT take you car to these guys! Oh and the 1 star was only because I couldn't do zero. So, I have a few issues with my car and as per usual I want to get a few different estimates from different shops, 'Fair' enough? I was pretty sure that I needed a new clutch so I phoned Fairview and talked to Peter who seemed very nice he gave me the quote. I then asked him if I could bring the car in to check the clutch, battery and brakes and get an estimate for all of the repairs. He said sure bring it in on Tuesday morning at 10 and we'll take a look at it. I dropped the car off at 10 with Peter who said oh you don't have an appointment but I can get you in...kinda weird that he doesn't remember, but hey whatever, people make mistakes and forget things, no big deal. At least they got my car in. He verified that I wanted the brakes, clutch and battery checked out and then I left them to it. By 4:30pm I was wondering what was taking so long so I phoned. Peter answered and I asked what the status was on my car. He said 'oh, we are just about done the clutch' ....hold on I said, I just wanted an estimate. Peter says well I just assumed that because you had phoned for a price on the clutch you wanted us to do it. No, I said I wanted an estimate on everything as this would determine if I kept the car or not. What do you want us to do, he asks, the tranny is taken apart and lying on the floor? I said stop everything. Well if you want me to put the old clutch back in I'll have to charge you $600 labor. Hmm, for his error... Anyway, before I completely lost it on him I said I have to call my girlfriend. Fine he says but hurry up your tranny is taking up space in the shop. I call the gf she freaks out. Did you sign anything she asks? Nope, nothing. After a heated discussion we decided that she would call because she would be more calm. Peter tells her that I told him to do the work, bs she calls him on that. Eventually he offers to knock $157 of labor off of the almost $650. Reluctantly she agrees because she didn't know what else to do. It was an interesting night at home that night but let's just say it was not a snuggle by the fire night. The next morning Peter calls me and says that the car should be done around noon. I ask him what he is going to do to make this right? He says that he sorted it with my GF and that's that. I said that the $157 was just to stop the bleeding and now he has to fix it. I have bent over backwards for you not charging for the tranny fluid and inspections, he says...who cares I say as far as I'm concerned he's bending me over forward. He says there's nothing else he can do unless I want him to put the original clutch back in.....tempting. And then he threatens me saying that he could keep my car or put a lien on it and go to court if I don't pay. Oh, and I have 2 of my guys that said that they heard you say you wanted me to do the clutch. Bravo, way to try to cover your a**. I said I will call him back. We're open to 5pm, let me know he says. So, of course I contact the BBB and Consumer Protection. Consumer Protection sends me the part of the Consumer Protection act that in part says:
'Unsolicited goods or services
12 (1) A consumer has no legal obligation in respect of unsolicited goods or services unless and until the consumer expressly acknowledges to the supplier in writing his or her intention to accept the goods or services.
(2) Unless the consumer has given the acknowledgment referred to in subsection (1), the supplier does not have a cause of action for any loss, use, misuse, possession, damage or misappropriation in respect of the goods or services or the value obtained by the use of the goods or services.
(3) Subsections (1) and (2) do not apply to goods supplied to a consumer on a continuing basis under a contract between the consumer and supplier.
(4) If it is alleged that the supplier supplied unsolicited goods or services, the burden of proof that the goods or services were not unsolicited is on the supplier.'
So, if I am understanding this, I shouldn't have to pay because I didn't give written permission. Anyway, to avoid the whole drama and a possible screaming match that may end up in a fight, we just paid and got the car back, just barely as one of the guys in the shop didn't want to release to car to my GF even though she was going to pay. Now we have to keep the car because of the repairs were done and we are out about $1000 right before Christmas. We weren't even going to do the repairs if needed until the new year.
