Despite receiving the payment, they failed to file the periodic test, which led to a $3,000 fine for the property. After attempting to address the issue with Day Elevator, it took four months for them to respond. They sent a letter stating they would not take responsibility for the fine due to their negligence, nor would they refund the payment for the service. While I understand that mistakes can happen, Day Elevator should have taken accountability since it was their failure to file the test as agreed upon in the contract. Unfortunately, she was encouraged to pay for the five-year contract, of which she only used 18 months. She has been ignored by this company repeatedly and is now working with the NYS Division of Consumer Affairs. She will not give up.
