NOTICE OF DEFAMATION, TORTIOUS INTERFERENCE, AND TRESPASS

Re: False statements concerning White Mountains Solar LLC and demand to cease and desist
I am Ben Burney, owner of White Mountains Solar LLC, 1801 E. Deuce of Clubs, Show Low, Arizona.
It has come to my attention that you have made, and continue to make, false and disparaging statements to my customers. Specifically, you have represented that White Mountains Solar performs substandard and unsafe work, and that batteries sold by this company are defective or inferior. Those statements are false. You sell the same batteries. You have also solicited those customers to purchase a battery from you for approximately $6,200 that this company and other solar contractors sell for approximately $3,000.
On this date you entered my place of business. My technician confronted you regarding your statements that our installations are terrible and unsafe. You did not retract those statements. You repeated and affirmed them.
This letter constitutes formal notice of the following:
Defamation. Your statements to third parties that White Mountains Solar performs defective, unsafe, or code-violating work, and that products we sell are "crap" or otherwise inferior, are false. Those statements injure this company's reputation and business. Continued publication of those statements will be treated as defamation.
Tortious interference with business relationships. Your conduct in contacting my customers, disparaging this company, and attempting to divert those customers to yourself on the basis of false statements constitutes interference with existing and prospective business relationships.
Demand to cease and desist. You are hereby demanded to immediately cease all false statements concerning White Mountains Solar, its workmanship, its personnel, and the products it sells. You are further demanded to cease contacting my customers for the purpose of disparaging this company or soliciting their business by means of such statements.
Trespass. You are notified that you are not welcome on the premises of White Mountains Solar LLC. Any further entry onto the property at 1801 E. Deuce of Clubs, Show Low, Arizona, will be treated as criminal trespass, and law enforcement will be contacted.
White Mountains Solar performs installations in accordance with applicable electrical and solar codes. Our lead electrician has more than twenty-five years of residential and commercial solar and electrical experience, including supervision of large crews and instruction in code compliance. If you contend that any installation by this company violates code, you are invited to identify the specific project, take photographs, and present them. Vague accusations made to customers are not a substitute for evidence.
This company has not disparaged your work to customers. When asked why your pricing is higher, the response given has been that your overhead may differ. That courtesy will not be extended if you continue the conduct described above.
If the statements and solicitation described in this notice continue, White Mountains Solar LLC will pursue all available civil remedies, including claims for defamation and tortious interference, and will seek damages, injunctive relief, and costs, without regard to the time or expense required.
Govern yourself accordingly.
