I don't want to write this, but I must. If I don't post this, someone else may endure the same experience. The Toney Law Firm appeared unable to manage my husband's probate while protecting my assets (large property, 2 homes). My husband died, unexpectedly. My daughter urged me to contract with Mr. Toney's firm (for probate) because "daddy's friend" (also an attorney) recommended them. I paid upfront fees, knowing a fellow Gator alumnus would take care of me "in all kinds of weather." I must say, though, that nothing about my experience with the firm represented "compassionate legal services for elders;" it was profoundly upsetting and challenging. I am paraphrasing all remarks. At our initial meeting, I was seriously injured (not my fault), disabled, & in significant pain...vulnerable. Mr. Toney advised I was entitled to only HALF of my property (wedding gift, 1983), appearing confident that his plan for managing the probate was lawful and that other attorneys would agree! It appeared nearly 4 decades of marriage didn't matter; there was no Will. I had invested in the property over many years. I was provided a "flow chart" and advised, "This is the law, there's nothing you can do." Mr. Toney said, "Getting another opinion will only waste time & money." I was asked to record all mileage/expenses. Then, things seemed to change; it appeared the firm cared nothing about me. I left feeling hopeless and helpless. I followed instructions while researching Fla. statutes related to marital assets. I was in tremendous distress. I had no intention of interfering with the courts but I politely emailed to ask if Florida had any statutes allowing Mr. Toney to request faster progress, as I was disabled, facing 3 surgeries. The response was most unkind, in all CAPITAL letters. I advised the firm regarding my research of state statutes, explaining my investment of money and time, over many years, yet I felt disregarded. I recall being "reminded" that expressing concerns and asking questions (to excess) could result in client termination (with a loss of funds paid). The courts were blamed for the lack of progress. In sheer desperation, I requested a face-to-face meeting with Mr. Toney, but neither he (nor his associates) were available. The office administrator advised that Mr. Toney was out of the country (another staff member said he was in the office). I was offered a 15-minute phone meeting 3 weeks from the date of my request. After SEVEN months of tears, anxiety, lost sleep, and emotional pain, it appeared Mr. Toney's plan was going forward, regardless of my concerns. I then consulted with another attorney who explained I could hire her; she would ask the Courts to terminate Mr. Toney's firm from the probate. While still under contract with Scott Toney, I sold my property. At closing, I asked (witness present), "Mr. Toney, are you absolutely sure there are no state statutes/legal processes that will allow me to retain more than half the value of my property?" Scott Toney shook his head, saying "No. You should have come to me before your husband passed away." Soon, the Courts terminated my contract with the Toney Law Firm. The courts weren't "slow," after all; each new Court Order (written by the new attorney) was signed within 72 hrs. The courts granted me the TOTAL value of my property. A subsequent Court Order required Mr. Toney to forward all funds to my new attorney. I lost a substantial sum of money to the Toney Law Firm. I paid the new attorney to complete the probate and to develop another set of "end of life" documents, for me (I was advised the documents prepared by the Toney Law Firm contained errors). I would say one of the worst aspects of this experience is I can no longer trust licensed professionals, even a fellow Gator. In fact, I can't trust anyone, ever again. This review has been reviewed before made the decision to post it. I have been assured that my words are accurate. I have no doubt that the firm is quite capable of completing other legal tasks but I cannot recommend you contract with the Toney Law Firm to manage your probate.
